초록
환경영향평가(EIA)는 오랫동안 기업활동으로부터 환경에 대한 부정적 영향을 조기에 제어·예방하는 중요한 법적 제도로 인식되어 왔다. 이 과정에서 주민들의 참여는 필수적이다. 왜냐하면 주민참여는 깨끗한 환경에서 살아갈 권리를 실현시키는 것을 의미할 뿐만 아니라, 보다 합리적, 객관적, 효과적 의사결정을 지원하기 때문이다. 즉, 주민참여는 환경영향평가 과정의 객관성을 보장하는데 도움이 된다. 베트남에서는 환경영향평가 보고서 심의를 요청하기 전 주민의견을 탐문하는 것이 필수적이다. 법제의 제정과 개정을 통하여 주민의견을 탐문하기 위한 법적 기반이 보다 효과적이고 과학적으로 마련되어 있으나, 현재 일부 심각한 법적 문제가 여전히 남아 있다. 이러한 법적 문제점으로 인하여 환경영향평가에서 주민참여에 대한 입법취지를 충실하게 달성하기 어려울 뿐만 아니라, 환경과 같은 중요한 사회적 분야에 대한 주민참여권이 충분히 보장되지 못한다. 본 연구가 현행 베트남 환경영향평가에서 주민의견 탐문절차에 대한 법제 상황과 법적 쟁점 등을 소개하고 분석하는 데 중점을 두고 있다. 이를 바탕으로 입법취지에 합당한 주민참여 절차를 점진적으로 형성시키기 위하여 주민의견 탐문의 효율성을 개선하기 위한 방안을 제시하고자 한다. 또한, 이 글을 통하여 국내 사업자뿐만 아니라 베트남에서 투자 활동을 하고 있거나 계획하고 있는 한국 투자자 등 외국인 투자자들에게 베트남 환경법에 대한 이론적이고 실무적인 지식을 제공하면서 투자 활동을 지원하고자 한다.
Abstract
Environmental impact assessment(EIA) has long been recognized as an important mechanism to control, prevent, and limit the project’s impacts, especially negative environmental impacts. Throughout this process, public consultation is considered an inevitable mechanism. Public participation in the EIA process by contributing opinions on investment projects not only means realizing the right to live in a clean environment but also supports effectively the process of decision-making. In other words, public consultation plays an important part in controlling the objectivity of opinions and decisions that have been made throughout the EIA process. In Vietnam, public consultation is a mandatory process that must be carried out before requesting a state agency to appraise the EIA document. Along with amending and supplementing the legislation in Vietnam, although the regulations on public consultation in EIA have been significantly improved, several serious legal issues still exist, making the effectiveness of legislation not achieved. In addition, this is also considered the reason why ensuring people's right to participate in social issues such as the environmental aspect becomes more difficult. This study introduces and analyzes Vietnam legislation’s current situation and legal issues related to public consultation in EIA. On that basis, proposing some capable solutions to improve the public consultation process, gradually realizing a desired process for legislative purposes. The research aimed to provide theoretical and practical knowledge about Vietnamese Law on the Environment not only for domestic subjects but also for foreign investors such as Korean investors, who intend to conduct investment activities in Vietnam.
