Kingdon의 정책흐름모형을 적용한 중대재해처벌법의 제정과정 분석

2021년 1월, 중대재해처벌법이 국회를 통과하였다. 그동안 산업재해 근절을 위한 정책적노력이 이어졌음에도 불구하고 많은 노동자들이 사망에 이르는 안타까운 사고가 계속되자기존의 법률 체계를 넘어 원청기업과 경영책임자에 대해서도 형사책임을 물을 수 있도록하는 법 제정의 목소리가 높아졌다. 그러나 국회심의는 정체되었고 국회에 발의된 중대재해처벌법안도 좀처럼 논의되지 않았다. 하지만 2020년 11월 국회내 변화의 움직임이 나타났다. 좀처럼 진행되지 못했던 중대재해처벌법의 논의가 극적으로 추진되더니 본회의 통과에 이른 것이다. 무엇이 이러한 변화를 이끌었는가? 본 논문은 중대재해처벌법이 실제 국회 입법으로 완성되는 과정을 Kingdon의 정책흐름모형을 활용하여 분석한 것이다. 분석결과, 이천 물류센터 화재사고로 인한 대규모 인명피해가 초점사건으로 작용하였고, 태안화력발전소 사고 희생자의 어머니가 중대재해처벌법 제정을 촉구하는 정책혁신가로 활동하면서 정책문제 흐름과 정책대안 흐름 및 정치 흐름이 결합하고 정책의 창이 열리며 법안통과라는 정책변동이 이루어지게 되었다고 평가할 수 있다.
Abstract
This paper analyzes the process of enacting the SERIOUS ACCIDENTS PUNISHMENT ACT using Kingdon's policy stream model. It can be analyzed that the enactment of this law was made when the stream of problems such as industrial accidents, the policy stream such as industrial accident prevention measures, and the political stream of responding to public opinion met and opened a policy window. In this respect, the legislative process of the SERIOUS ACCIDENTS PUNISHMENT ACT is an appropriate case to analyze through Kingdon's policy stream model. As a result of the analysis, the massive casualties caused by the fire accident at the Icheon Distribution Center acted as a focus event, and the mother of the victim of the Taean thermal power plant accident acted as a policy entrepreneur calling for legislation. As a result, the stream of problems, the policy stream, and the political stream were combined, and the window of policy was opened. This paper shows the importance of focus event and the role of policy entrepreneur in policy change
