초록
본 글은 2023년에 공간된 판례 가운데, 「민사소송법」에 관련된 대법원의 중요 판결을 분석한 것이다. 2023년 선고된 11건의 대법원 판결을 분석하였는데, 대법원이 원심을 파기한 경우가 상당히 많았다. 우리나라 법원의 재판권에 관한 2019다247903 판결, 장래이행의 소의 적법 여부에 관한 2022다286786 판결, 채무의 부존재확인을 구할 확인의 이익에 관한 2021다277525 판결, 법원의 석명 또는 지적의무에 관한 2020다210860, 210877 판결 및 2023다223171, 223188 판결, 문서제출명령에 관한 2018스34 전원합의체 결정, 증거·증명에 관한 2022다219427 판결, 소의 취하에 관한 2023므12218 판결, 판결경정에 관한 2022그779 결정, 소송비용에 관한 2022마6885 결정, 즉시항고에 관한 2023그585, 586 결정을 분석하였다. 위 11건 이외에, 지면 관계상 여기에서 판례 전부를 다루지 못하였고, 몇 개의 판례는 추가로 마지막에 간단히 소개하는 것에 그쳤다.
Abstract
This article analyzes important decisions of the Supreme Court related to the “Civil Procedure Act” among the precedents published in 2023. 2019Da247903 on the jurisdiction of Korean courts, 2022Da286786 on action for future performance, 2021Da277525 on the interrest of confirmation of non-existence of debt, 2020Da210860, 210877 and 2023Da223171, 223188 on the duty of the court to give notice or point out, 2018Seu34(En banc order) on the order for the submission of documents, 2022Da219427 on evidence and proof, 2023Meu12218 on the dismissal of a complaint, 2022Geu779 on correction of judgment, 2022Ma6885 on fixing the amount of court costs, and 2023Geu585, 586 on immediate appeal. It is not that there are no meaningful precedents other than the 11 cases above, but due to space constraints, all of them could not be covered here, and a few additional precedents are briefly introduced at the end.
