정보행정법과 행정법체계의 변화 - ʻʻ행정법의 기초(Grundlagen des Verwaltungsrechts)ʼʼ 제3판(3. Aufl. 2022)의 논의를 중심으로 -

개별행정법분야별 연구가 활발한 오늘날, 그 연구 성과들을 행정법의 기본이론에 반영하는 것은 더디다는 지적도 적잖다. 개별행정법분야 연구물들이 기존 행정법체계가 지향해왔던 ‘소송법학’과 상이한 ‘제도법학’을 추구하는 경향이 적잖다는 점에서 그럴 수 있는데, 그렇다면 행정법연구 목적을 ‘사회문제 해결에 적실성 있는 제어와 조종을 가하기 위한 조건과 구조를 찾아가는 것’에 두고 행정법연구의 정체성을 입법학과 규제학, 행정조직법학과 행정절차법학, 개별행정법연구 등으로 새롭게 새겨가고 있는 독일 신사조행정법학계의 새로운 행정법 체계형성에 관한 논의들을 살펴볼 필요가 상당하다. 대표적인 신사조행정법학자인 Eberhard Schmidt-Aßmann과 Christoph Möllers가 각각 주장하는 새로운 행정법체계와 체계형성 가능성, 방법론, 일반행정법과 개별행정법 간 관계 등을 먼저 살펴보고, 그 위에 대다수 신사조행정법학자들이 주목하는 새로운 행정법연구 분야인 ‘정보행정법’ 분야의 주요 연구내용들을 올려놓으면, Schmidt-Aßmann과 Möllers의 주장내용이 무엇인지 보다 구체적으로 살펴볼 수 있다. 신사조행정법학자들의 정보행정법 연구, 곧 ① 행정 업무에서 정보 및 커뮤니케이션의 중요성(Thomas Vesting), ② 행정의 커뮤니케이션 인프라(Karl-Heinz Ladeur), ③ 개인정보 및 데이터 처리(Marion Albers), ④ 행정의 투명성과 정보 접근의 자유(Christoph Gusy), ⑤ 행정에서의 정보관계(Thomas Wischmeyer)를 각 살펴보면, 농도의 차이는 있으나 아래의 공통점을 확인해 볼 수 있다. ① 정보, 지식, 데이터. 커뮤니케이션 같은 개념을 행정법의 새로운 기본개념 삼아 행정법의 새로운 체계를 모색한다는 점, ② 사후적 사법통제연구를 넘어 정보행정에 맞는 절차통제, 조직통제연구를 모색하는 점, ③ 사회문제 해결에 적실성을 담보하기 위한 ‘고품질 지식’ 형성을 추구한다는 점, ④ 정보행정법연구를 중심으로 환경법, 정보통신과 미디어법, 보건 및 약학법, 금융규제법, 첨단기술법, 사회(복지)법, 경찰법 분야 상호간 참조영역(Referenzgebiets) 연구를 시도하면서 ‘보장국가론’ 같은 개념을 교두보 삼아 행정법체계의 변화를 모색해가는 점, ⑤ 민주주의와 법치주의를 중심에 두되, 연방헌법재판소의 결정례들에는 다양한 태도를 취하고 있는 점이 그것이다. 정보행정법연구의 시사점을 중심으로 우리나라에서도 행정법체계의 변화상에 관한 연구를 모색해 볼 필요가 적잖다.
Abstract
This study focuses on some debates over the formation of a new administrative law system in German “New Administrative Law Study“, first of all. Although the content of the debate between representative new administrative law scholars is abstract, the content becomes more concrete when examining ”Information Administration Law“ researches by New Administrative Law scholars : ① Importance of Information and Communication in Executive Branch(Thomas Vesting), ② The Communication Infrastructure of Executive Branch(Karl-Heinz Ladeur), ③ Personal Information and Data Processing(Marion Albers), ④ Transparency and Freedom of Access to Information (Christoph Gusy), ⑤ Information Relations in Executive Branch(Thomas Wischmeyer). Among the researches of the above scholars, the common denominators regarding the formation of a new administrative law system are as follows. ① The scholars seek new administrative law systems by suggesting that some concepts such as Information, Knowledge, Data and Communication should be basic concepts of Administrative Law. ② The scholars seek new administrative procedure/organization law study and new administrative law system focused on “Information Administrative Law” study, rather than existing Administrative Law study focused on judicial control. ③ The scholars pursue “efficacious knowledge formation process” to ensure relevance in solving social problems and effectiveness, efficiency, rather than strict legality control. ④ Focusing on “Information Administrative Law” study, the scholars attempt to research “Reference Area” in the fields of Environmental Law, Communication and Media Law, Health and Pharmaceutical law, Financial Regulation Law, High-tech Law, Social (welfare) Law, and Police Law, using concepts such as “Ensuing state theory(Gewährleistungsstaat)” as a bridgehead for administrative law for reforming Administrative Law system. The current status of “Information Administrative Law Study” in German shows many implications on Administration Law in Korea such as issues of the relationship between General Administrative Law and special administrative law, the possibility of developing new Administative Law system.
