대법원이 구성한 디스커버리 연구반은 2022. 10.경 그 연구 결과로 당사자의 문서 등에 대한 보존의무를 도입하는 등 「민사소송법」의 문서제출명령 제도를 개정하자고 제안하였다. 이는 민사절차에 관한 법 중 일반법을 개정하자는 것이므로, 다른 특별한 규정이 없는 한 「민사소송법」이 적용되는 특별법들에 미치는 영향을 고려할 필요가 있다. 특히, 소액사건에는 「소액사건심판법」에 특별한 규정이 있는 경우를 제외하고는 「민사소송법」이 적용되므로, 「민사소송법」을 개정할 때는 소액사건에도 이를 적용할 것인지 검토하여야 한다. 이때 디스커버리가 적극적으로 활용되는 미국 법리를 참고하는 것이 도움이 된다. 그런데, 미국의 많은 주는 소액사건에 대해서는 디스커버리 적용을 제한한다. 이러한 미국의 사례를 참고하면, 한국 「민사소송법」에 디스커버리를 도입할 때 소액사건에도 전면적으로 도입할 것인지 신중하게 판단하여야 한다. 디스커버리 절차가 어떻게 도입될지에 따라 다를 수 있으나, 소액사건은 주로 소송대리인 없이 비전문가인 당사자가 직접 관여하므로, 그들이 디스커버리 권한이나 의무를 제대로 이해하지 못해 불이익을 입을 가능성이 크기 때문이다.
Abstract
The Discovery Research Group, formed by the Korean Supreme Court, submitted a report containing the research results around October, 2022. The report proposed, by revising the Civil Procedure Act, introducing a kind of U.S.-style discovery. Since the proposal proposes amendments to the Civil Procedure Act, we should consider the impact of amending the Civil Procedure Act on other procedural laws where the Civil Procedure Act also applies. In particular, since the Civil Procedure Act also applies to small claims cases, unless there are special provisions in the Small Claims Tribunal Act, it is necessary to consider whether or not to apply the proposal to small claims cases. For this purpose, it would be helpful to refer to the US jurisprudence on the subject. It turns out that many states in the United States limit the application of discovery to small claims cases. Considering the US jurisprudence, even if a type of U.S. discovery is introduced in Korean civil procedure law, we should carefully consider whether it should also be introduced in small claims cases. It may differ depending on the specifics, but it is highly likely that non-experts will suffer, rather than gain, by the amendment because they do not understand the rights and obligations of the introduced discovery process.
