대법원이 2021년 구성한 디스커버리 연구반은 문서제출명령제도를 개편한 한국식 디스커버리 도입을 제안하며 당사자에 대한 제재를 강화할 방안 중 하나로 패소판결을 할 수 있게 하자고 하였다. 이 논문은 미국 연방 민사소송 절차상 디스커버리 제재 법리를 살펴 위 패소판결을 운용하기 위한 시사점을 검토한다. 이 논문 제II장에서는 미국법상 디스커버리 의무 위반에 관한 제재 법리를 제재인 기각판결(dismissal)과 제재인 인용판결(default judgment)을 중심으로 살핀다. 제III장에서는 위와 같이 소개한 법리가 한국식 디스커버리 제도를 도입하면서 그 위반에 대한 제재로 패소판결을 정하여 운영할 때 주는 시사점을 살핀다. 우선, 판결로 원고를 제재할 때는 종국판결에 해당할 것임을 전제로 청구가 객관적으로나 주관적으로 병합되었으면 어떠한 판결을 하게 될 것인지 살핀다. 판결로 피고를 제재할 때도 마찬가지로 청구가 객관적으로나 주관적으로 병합되었으면 어떻게 종국판결을 하는 것이 적절한지 살핀다. 또한, 어떠한 때 제재인 인용판결을 중간판결로 하는 것이 적절한지 살핀다. 마지막으로 상소가 있었을 때 상소심이 적용할 심리기준을 고려한다.
Abstract
The Supreme Court formed the Discovery Research Group (hereinafter referred to as the 'Discovery Research Group'), and the Discovery Research Group proposed strengthening sanctions against the parties involved by introducing dismissal and default judgment as one of the specific measures when introducing Korean-style discovery. This paper examines the discovery sanctions law in the U.S. federal civil litigation focusing on dismissals and default judgments. In Chapter II of this paper, we examine the legal principles of sanctions for violations of discovery obligations under U.S. law, and examples of their operation in U.S. practice, focusing on dismissal and default judgment. Chapter III focuses on the implications of the legal principles introduced above when introducing dismissal and default judgment as a sanction when introducing the Korean-style discovery system. Chapter III also discusses considerations when imposing sanctions by a judgment under Korean civil procedure and the standards for appellate courts in the event of an appeal.
