불법드론에 의한 민법상 지상 제3자의 법익에 관한 연구 - 긴급피난과 국가배상법을 중심으로 -

While drones are used in various areas and have a positive impact on human life, incidents that cause damage through various illegal activities using drones are also becoming more frequent. At first, it was private damage, such as illegal filming and noise pollution, but now criminal damage is occurring to countries or unspecified people, such as the invasion of key national facilities using drones and bombings. The problem is that when the military or government agencies take measures such as shooting down or dropping illegal drones in important national facilities, laws and systems to compensate for violations of legal interests (life and property) caused by third parties and drone crashes on the ground are practically insufficient. Therefore, in this paper, we will present major cases of infringement of the legal interests of illegal drones at home and abroad, and examine whether the act of shooting down drones at important facilities constitutes an emergency evacuation under civil law from a legal theoretical perspective to see if the reason for the illegal drone is applicable. In addition, by examining domestic laws on illegal drones and whether the National Compensation Act is applied, we would like to suggest a direction of development to protect the lives and property of the people in national security.
