인공지능을 이용한 범죄예방에 관한 헌법적 연구 - 안면인식기술(FRT)에 대한 규범적 통제를 중심으로 -

This paper discusses the legal justification for the use of facial recognition technology in crime prevention. In order to do so, it identified the European- level guidelines for the use of facial recognition technology from the European Court of Human Rights' decision(Glukhin v. Russia) from a comparative legal perspective and presented the criteria for the use of facial recognition technology in crime prevention. The use of facial recognition technology is prohibited in principle as sensitive information with a high degree of protection, and the use of the technology allows for continuous tracking individuals, so it is likely to violate fundamental rights. However, it can be used only when there is an exceptionally public purpose, so its use in the crime prevention stage is limited to cases where law enforcement agencies have a high risk of crime. Normative controls are still necessary in these cases. Under the current law, the use of facial recognition technology in crime prevention is subject to the control of the Personal Information Protection Commission, so clarity on the procedures and requirements is needed.
