북극항로의 이용에 따른 국제통항법제에 관한 연구

부산항에서 유럽 로테르담까지 기존 남방 경로인 수에즈 운하를 이용하는 경우는 1만9천900㎞를 35일 동안 선박이 항해해야 하지만, 북극항로를 항해하는 경우에는 1만4천300㎞를 25일만 항해하면 된다. 시간이 곧 돈인 해운업계에서 운송 기간이 3분의 1이 단축되는 북극 항로에 관심을 가지는 것은 너무나도 당연한 것이다. 기후변화로 인하여 물리적으로 북극이 열렸고 정치적 개방으로 국제적 이권이 발생했으나, 국제정세에 영향을 받게 되었다. 우리나라도 2000년대에 들어와 개방된 북극에 관심을 갖기 시작하였다. 이러한 상황에서 북극해항로(NSR) 이용에 관련하여 경제적인 협력과 북극 해양환경보호에 관한 공통의 전반적인 목표에도 불구하고, 미국과 캐나다, 러시아 3개 북극연안국가는 북극해 양측의 극항로의 법적지위에 대한 견해에 있어서 한 가지 큰 차이를 가지고 있었다. 미국은 두 항로를 외국 선박이 광범위한 항행권을 갖는 국제 해협으로 간주한 반면, 소련은 해안선을 따라 수역을 내수로 간주했다. 러시아에 있어 북극은 경제적 측면뿐만 아니라 안보 측면에서도 중요하게 작용한다. 현행 법률의 분석을 통해 캐나다와 러시아의 북극해항로와 관련된 세부조치들이 국제법 원칙에 부합하는지의 여부를 면밀히 검토할 필요가 있다. 이와 함께, 국제법적인 논리에 입각하여 러시아내 관련 법령을 정비할 수 있도록 유도하고 북극해항로의 경유해협의 법적 문제와 관련된 사항들에 대해 관련 국제기구를 통해 지속적으로 논의할 필요가 있다.
Abstract
Sea transport is the main mode of transport in international trade. Accordingly, the shipping and port industries play an important role in the global economy. In the case of the shipping and port industries,As the ices in the Arctic are melting, the region is currently undergoing significant changes in terms of increased activity such as shipping, tourism, fishing and exploitation of other natural resources. This increased activity leads to new challenges regarding legislative regulation in the region and there are several stakeholders with different interests within the area, which complicates the regulation process further. Given this increased activity in the Arctic region in recent years and the urgent need of regulation that follows, the main purpose of this thesis is to examine the current legal situation in the area with a particular focus on the interaction between shipping regulations on different levels. Focus will mainly be put on the connection between national regulations justifiable according to Article 234 in the United Nations Convention on the Law of the Sea (UNCLOS) and international regulations such as the International Code for Ships Operating in Polar Waters (the Polar Code), which is currently being negotiated in the nternational Maritime Organization (IMO). In this regard, the content of Article 234 UNCLOS itself will also be evaluated in the light of the Polar Code.
