「국토기본법」의 규율 내용에 관한 법적 검토

The Framework Act on National Land, which has been in effect since January 1, 2003, (Act No. 6654, February 4, 2002, enacted), aims to specify the ideology and basic direction to be aimed at in establishing and implementing plans and policies for national land, to establish a national land plan and to prepare institutional mechanisms for systematic implementation thereof, and to abolish and supplement and develop the previous Comprehensive National Land Construction Plan Act. This Act stipulates the basic principles of national land management, sets the goal of balanced development of the national land, creation of competitive national land conditions, creation of national land conditions to improve the quality of life of the people, and sets national land plans as a means of realizing these goals. The term "national land plan" means a plan to establish and achieve the direction of development that the national land should aim for in response to future economic and social changes when utilizing, developing, and preserving national land, and shall be classified into a national land comprehensive plan, a wide area plan, a city-gun comprehensive plan, a regional plan, and a sectoral plan. According to this law, the Framework Act on National Land stipulates that the comprehensive national land plan is the basis of the ultra-wide area plan, the comprehensive provincial plan, and the city and county comprehensive system, and that sectoral and regional plans should be in harmony with the comprehensive national land plan. As such, the Framework Act on National Land has the character of a basic law on the comprehensive management of national land. Consistency, connection, and consistency with national land plans and policies shall be secured not only in relation to national land management, balanced development of national land, competitive national land conditions, creation of national land conditions to improve the quality of life of the people, environment-friendly national land management, and in order to establish and implement national land plans and policies that meet these basic matters, it is necessary to ensure consistency, connection, and consistency with plans in specific areas such as the environment. In particular, this paper aims to examine whether future improvements are needed by reviewing public hearings and national land plans and policies in the process of establishing national land plans, focusing on the contents of the national land plan and its establishment procedures, to maintain the function of the National Land Framework Act as a basic law on the comprehensive management of the country.
