미국의 새로운 형태의 의료·요양·돌봄 제공 방식에 대한 법적 고찰

초록
우리나라의 고령화는 매우 빠른 속도로 증가하고 있다. 고령자의 경우 이해력 저하 및 인지능력 감퇴, 신체능력의 저하, 사회적 고립과 가족에 대한 의존도의 증가로 대표적인 사회적 약자에 해당하며, 요양과 돌봄이 적극적으로 필요하다. 고령자 외에도 장애인, 의료취약지 소재 국민들에게도 의료, 요양, 돌봄의 상호보완적인 체계가 적극적으로 요청된다. 현행 법제 하에서 의료나 요양ㆍ돌봄 서비스는 의료기관을 중심으로 요양병원, 요양원 등에서 국민건강 보험급여과 노인장기요양서비스가 이루어지고 있다. 우리나라는 의료법상 원칙적으로 의료인은 개설된 의료기관 내에서만 의료업 수행이 가능하도록 규정되어 있다. 따라서 이용자가 의료기관이 아닌 주거지에서 의료나 요양의 제공, 즉 재택의료를 받고자 하더라도 엄격한 요건 하에서만 예외적으로 가능하다. 또한 사법기관은 의료인에 의하여 이루어져야 하는 의료행위의 범위를 넓게 이해하고 있어, 재택의료를 통해 이용자가 제공받고자 하는 행위의 상당 부분이 의사의 개입이 필요한 의료행위로서만 가능하여 간병인 이용에 걸림돌이 되고 있다. 미국은 재택의료와 관련하여 교통수단에 진료 장비를 장착하고 의료팀을 조성하여 지역사회 내 의료업을 수행하는 이동형 진료소 제도를 연방 전체로 확대하고 있고, 의료인이 아닌 가정보호보조원이 수행할 수 있는 행위 중에서 의료행위의 성격을 지니는 것이 있더라도 이용인의 일상을 위하여 필요한 일정 부분은 수행이 가능하도록 범위를 넓혀가고 있는 추세이다. 향후 우리나라에서도 요양ㆍ돌봄 형태의 재택의료 수요가 점차 늘어날 것으로 예상되는바, 법정책 방향에 있어서 미국에서와 같은 새로운 형태의 의료 제공 방식의 도입과 의료행위 범위 조율과 관련된 전향적인 판단이 필요하다.
Abstract
The population of South Korea is aging at an extremely rapid rate. The elderly require much care and nursing due to their decline in comprenhension, coginition, physical abilities as well as social isolation and increase in dependence on family. The disabled and residents of medically vulnerable regions are also in dire need of an active healthcare system. In the current legal system, “National Health Insurance” and “Long-term Care Insurance” are ways through which medical, nursing, and care services are provided in medical institutions, nursing hospitals, and nursing homes. In principle, licensed medical personnel may only practice within an established medical institution. Therefore, at-home healthcare services may only be allowed under strict requirements even when patients are in need of such services. In addition, according to Judiciary, a considerable proportion of the medical practices that patients desire can only be performed by licensed medical personnel, which also hinders the widespread use of home healthcare services. In the United States, Mobile Health Clinic (MHC)s, vehicles that are set up with medical equipment and are staffed with medical personnel deliver healthcare services within the community. The US Law also grants permit to Home Health Aide (HHA)s to perform medical procedures to some extent. As the demand for home healthcare is expected to gradually increase, the Korean law needs to shift towards a prospective manner regarding the scope of ‘medical practices’ as in the United States.
