프랑스 형법상 청소년 마약류 범죄에 대한 처벌 및 시사점

Recently, the drug issue that heavily affects young people has been raised in Korean society. In France, this seriousness was pointed out long time ago. The French legislature has established and modified the drug-related laws to regulate narcotic crimes since the 1800s. First of all, the law of 19th July 1845 was adopted under the old penal code(1810). This law was the foundation of following other legislations. After that, the law of 12th July 1916, the law of 13th July 1922, and the law of 24th December 1953 extended the range of punishment and subject. However, general prevention based on the intensification of punishment reached a limit, and the importance of special prevention had been gradually emphasized. This feature was shown from the adoption of 31st December 1970. Under the new penal code(1992), drug prevention policy has focused on education. It is especially aimed at teenagers. According to several statistics, the juvenile drug problem was serious at that time. The French legislature overall reflected it in the law of 5th March 2007. The French current law severely punishes instigating minors to take the drugs and to carry (etc.) them. The latter has higher illegality than the former. This French law system will give several implications for Korean law.
