2023년도 소비자법 판례 회고

In this paper, seven judicial precedents on the consumer law announced in 2023 are introduced and analyzed: Matters related to accommodation reservation platforms and unfair terms and conditions, two consumer organization lawsuits cases requesting mobile communication service providers to prohibit acts that violate consumer rights, a case claiming refund of unfair profits for residential electricity bills, issuance of a copy of the terms and conditions after signing a contract, and two cases on the interpretation of insurance terms and conditions. One of the characteristics in consumer transactions is the possibility of rational inattention. Therefore, consumers tend to avoid legal disputes. Nevertheless, the existence of any precedent in the area of consumer law means that consumers have already had a concrete dispute on a particular issue. Additionally, the existence of precedents is evidence of the possibility of legal relief on a specific issue. This is why we must look back on precedents. This is because the positive and developmental influence that concrete judicial judgments have on theoretical research and legal practice is important. In particular, there are many major rulings announced in 2023 for which our society has been awaiting answers from the court for a long time. In that respect, its importance is even greater.
