소방법상 소방본부장의 법적 지위에 관한 쟁점과 개선방안

The state has a duty to protect its citizens from fires and disasters, and when such fires and disasters occur, Fire Agencies are the organizations on the front line that protect the lives and property of citizens. Fire Agencies have gone through many changes and the National Fire Agency is currently under the Ministry of Public Administration and Security and carries out independent work and Metropolitan local governments have a firefighting headquarters dedicated to fire service duties, and the person responsible and representing this firefighting headquarters is the director general of a firefighting headquarter. However, although the director general of a firefighting headquarters has a hierarchical relationship with the Fire Commissioner of the National Fire Agency, it has a very strange structure in which it is under the command and supervision of the Mayor/Do Governor. A structure like this does not cause any particular problems in normal times, but in the event of national-scale fires and disasters, who will be responsible for fire suppression or disaster relief, and how and in what way the Firefighting Force scattered in each region will be gathered? Without a clear guideline, this creates a problem in which we have no choice but to respond to fires and disasters on a case-by-case basis. Accordingly, the fire-fighting system must be improved, changing the current firefighting headquarters to a local fire department and reorganizing it into an independent organization that does not receive direct command and supervision from the Mayor/Do Governor. If so, we will be able to respond quickly and efficiently to fires and disasters that are becoming increasingly large-scale and nationwide. In addition, if Fire Service Duties are converted to national affairs, unity with the status of Fire Officials can be achieved, the latest firefighting equipment can be built based on a solid national budget, sufficient human resources can be secured, and a generous compensation system can be established. Through this, there is a need to resolve the problem of regional imbalance in the Firefighting Force.
