『만국공법』의 판본학적 계보 고찰

19세기 중엽 이후로 이루어졌던 대규모의 서학(西學) 번역은 이후 동아시아인들의 사상과 사회 전반에 근대적 변화를 가져왔다. 그러한 근대적 서학 번역의 출발점이자, ‘천하’(天下)라는 지역적 질서에서 세계 체제로의 편입이라는 근본적인 변화를 가져온 대표적인 번역서를 꼽으라면 헨리 휘튼(Henry Wheaton)의 Elements of International Law를 중국어 고문으로 번역한『만국공법』(萬國公法)을 빼놓을 수 없을 것이다. 그로 인해 그동안 국내외의 여러 학자들에 의해 『만국공법』에 대한 연구가 이루어져 왔고, 그 가운데는 동아시아에서의 근대적 국제질서 형성에 관한 정치 외교학적 연구나, 서구 국제법과 관련된 근대적 담론의 수용 과정 및 번역어에 대한 연구 성과들이 적지 않게 나왔다. 하지만 『만국공법』의 번역과 수용과정을 전후로 나타났던 다양한 저본과 판본들에 대한 서지학 내지는 판본학적 접근을 통해 그 계보를 구체적으로 연구한 논문은 거의 많지 않은 편이다. 본고에서는 『만국공법』이 저본으로 삼고 있는 휘튼의 저서로부터 시작해서 일본의 『만국공법』 번각본과 해설본에 이르는 다양한 판본들의 구성과 형식에 대해 살펴보고 그 의미를 해석함으로써 그 판본학적 계보를 종합적으로 고찰해보고자 한다. 이 같은 문제의식을 가지고서 본론에서는 『만국공법』의 원저였던 헨리 휘튼의 Elements of International Law의 판본이 어떻게 발전해왔는지, 그리고 그 중국어 번역본인 『만국공법』 판본의 계보는 어떻게 전개되었으며, 그 사후 영향과 역사적 의미는 어떠하였는지 등의 문제에 대해 살펴보고자 한다.
Abstract
The large-scale translation of Western thoughts from the mid-19th century brought about modernization in East Asian thought and society in general. The starting point of these modern translations, and the representative translation that brought about a fundamental change from the local order of “heavenly kingdom(天下)” to the global system, is Wan guo gong fa(萬國公法) . which is the classical Chinese translation of Wheaton’s Elements of International Law . As a result, scholars at home and abroad have conducted research on Wan guo gong fa, including political and diplomatic studies on the formation of the modern international order in East Asia, and studies on the process of acceptance and translation of modern discourse related to Western international law. However, there are very few papers that specifically study the genealogy of various editions that appeared before and after the translation of Wan guo gong fa , through a bibliographical or genealogical approach. In this article, I examine the textual genealogy of the various editions, starting with Wheaton’s Elements of International Law and ending with the copied editions and commentaries in Japan, by examining their composition and format, and by interpreting their meaning.
