베트남법에 있어서 법령 간의 충돌ㆍ불일치 현상과 법규범문서제정법
Conflicts and inconsistencies between laws and regulations in Vietnam and the Law on promulgation of legal documents

베트남에서는 우리의 법령(法令)에 해당하는 것을 ‘법규범문서’라고 하는데, 이러한 법규범문서들 상호 간에 불일치ㆍ충돌이 자주 문제되고 있다. 심지어, 이러한 법규범문서들 간의 불일치ㆍ충돌은 외국 기업이 베트남에서 사업하기 어렵게 만드는 중대한 장애사유 중 가장 심각한 것으로서 언급되기도 한다. 베트남법에 있어서 법적 효력을 갖는 법규범문서는 매우 많으며, 발행기관도 다양하다. 우선 국가의 기본법으로서 헌법과 국회가 제정한 법률이 이에 해당함은 의문의 여지가 없다. 그 외에도 국회 상무위원회, 국가주석이 제정하는 령(令) 뿐만 아니라, 결의, 결정, 의정, 통달, 합동결의, 합동통달이 법규범문서로서 언급되고 있다. 각 법규범문서들의 규율 내용 내지 대상도 천차만별이다. 국정의 운영에 관한 거의 모든 내용을 담을 수 있는 법규범문서 형식이 있는가 하면, 규율 대상이 극히 한정되어 있거나 내부적인 사항에 그치는 것도 있다. 각 법규범문서들의 제정 절차, 효력 등을 규율하기 위하여 ‘법규범문서제정법’이 제정ㆍ시행되고 있다. 법규범문서제정법의 법문에 따르면, 법규범문서들 사이의 상하관계는 국회의 법률ㆍ결의(국회 상무위원회령ㆍ결의) > 정부의 의정 > 총리의 결정 > 장관 등의 통달 > 각급 인민평의회 결의(인민위원회 결정)의 순으로 정리할 수 있겠다. 베트남법에 있어서도, 하위의 국가기관이 상위의 국가기관의 법규범문서를 위반하는 법규범문서를 발행하는 것은 금지되며, 상위의 국가기관의 법규범문서에 반하는 법규범문서를 발행하였거나 상위 법규범문서의 규정으로부터 위임을 받은 범위를 벗어난 법규범문서를 발행한 하위의 국가기관은 그 발행에 대해 책임을 진다. 그러나, 이러한 원칙이 엄격하게 지켜지고 있는 것 같지는 않으며, 행정관청의 필요에 따라 자주 무시되고 있다. 법규범문서들 상호 간에 불일치ㆍ충돌이 유독 베트남에서 자주, 그리고 계속하여 발생하는 것에 대해서는 여러 가지가 원인으로 지적되어 왔다. 이 논문에서는 그 원인으로 지적되어 온 것들을 제도상의 측면, 법문화적인 측면, 현실적인 측면으로 나누어서 검토하였으며, 그러한 문제를 해결하기 위하여 베트남이 어떠한 노력을 기울여야 할 것인지도 언급하였다.
Abstract
In Vietnam, what corresponds to our laws and regulations is called 'legal document', and inconsistencies and conflicts between these legal documents are often problematic. Even, inconsistencies and conflicts between these legal documents are mentioned as one of the serious obstacles that make it difficult for foreign companies to do business in Vietnam. There are many legal documents that have legal effect in Vietnam, and there are various issuing institutions. First of all, there is no question that these are the Constitution and the laws enacted by the National Assembly. In addition, resolution, decision, decree, circular, joint resolution, and joint circular are mentioned as legal documents, as well as the ordinance and the order enacted by the Standing Committee of the National Assembly and the President. The contents and targets of the regulations of each legal document also vary widely. There are legal documents that can contain almost all contents about the operation of state affairs, and some have extremely limited targets or are limited to internal matters. “The Law on promotion of legal documents” has been enacted and implemented to regulate the legislative procedure and effectiveness of each legal document. Many things have been pointed out as the causes of frequent and continuous occurrences of inconsistencies and conflicts between legal documents in Vietnam. In this paper, what has been pointed out as the causes was reviewed by dividing it into institutional, legal-cultural, and practical aspects, and what kind of efforts Vietnam should make to solve such problems was also mentioned.
