법률용어의 한국수어 번역 전략 분석

연구 목적: 본 연구는 법원행정처에서 발간한 『형사절차에 관한 법률용어 수어집』(2020)에 수록된 130개 법률용어를 번역한 한국수어 법률용어 167개를 대상으로 하여 한국수어 번역에서 사용된 번역전략을 분석하였다. 연구 방법: 법률용어 번역 결과물을 분석하기 위해 Sarcevic(1997)이 번역전략으로 제시한 어휘적 확장, 기술적 풀어쓰기와 정의, 중립적 용어를 기준으로 사용하였다. 연구 결과: 분석 결과 높은 비율로 나타난 번역전략은 중립적 용어(86/167건), 기술적 풀어쓰기와 정의(61/167건), 어휘적 확장(20/167건)으로 나타났다. 결론: 중립적 용어가 가장 높은 비율을 차지했는데 한국어 법률용어의 어순의 영향을 간과할 수 없음을 확인하였다. 어휘적 확장은 법률용어의 의미를 정확하게 전달하는 효과를 가지는 것을 확인하였다. 끝으로 법률용어를 한국수어로 번역하는 과정에서 시각언어의 특징을 살린 번역과 한국수어 단어가 가진 미묘한 의미의 차이를 고려한 번역을 고려해야 함을 확인하였다.
Abstract
Purpose: This study analyzed the translation strategies used in the Korean Sign Language (KSL) translation, targeting 167 KSL legal terms that translated 130 legal terms contained in the 『Sign Language Glossary of Legal Terms for Criminal Procedures(2020)』 published by the National Court Administration. Methods: To analyze the legal terminology translation results, transposition are added to lexical expansion, descriptive paraphrase and definition, and neutral terms, suggested as the translation strategy by Sarcevic (1997). Results: As a result of the analysis, the translation strategies that appeared at a high rate were neutral terms (86/167 cases), descriptive paraphrase and definition (61/167 cases), and lexical expansion (20/167 cases). Neutral terms accounted for the highest proportion, and it was confirmed that the influence of the word order of Korean legal terms could not be overlooked. Conclusions: It was confirmed that lexical expansion has the effect of accurately conveying the meanings of legal terms. Lastly, it was confirmed that when translating legal terms into KSL, translation that takes advantage of the characteristics of visual language, and translation that takes into account the subtle differences in meanings of KSL signs should be considered.
