북한의 ‘사회보험 및 사회보장법’ 채택과 노동관계법령의 변화

초록
북한은 2021년 3월 3일, 조선민주주의인민공화국 최고인민회의 상임위원회 제14기 제13차 전원회의를 개최하고, ‘사회보험 및 사회보장법’을 채택하였다. 이번에 채택된 ‘사회보험 및 사회보장법’은 국가사회보험제도와 국가사회보장제도를 하나의 법령으로 통합하고, 김정은의 ‘사회주의 법치국가’로의 전환을 위한 노력과 코로나 사태 이후 경제난에 따른 재정적 부담 완화 및 군인 사기 진작과 애민정신 부각을 통한 체제결속 강화 등 기타 정치적인 목적 외에도 노동관계법적 변화와 관련한 여러 가지 의미가 있다. 첫째, 사회보험금 재원을 근로자 등으로부터 갹출할 수 있는 근거를 마련함으로써 코로나 사태 이후 경제난에 따른 국가의 재정적 부담을 완화함과 동시에 이러한 재원을 통해 일반 근로자뿐만 아니라, 여성, 노인, 아동, 장애인 등에 대한 보편적 사회보장방식을 시도한다. 둘째, 이 법 채택을 전후해 북한은 다양한 사회보장 관련 법제를 정비하여 이 법과의 정합성을 고려하는 한편, 헌법 및 여러 노동관련 법제에 산재해 있던 사회보험 및 사회보장관련 기준에 부합하도록 세부적인 기준을 마련함으로써 헌법 및 노동관계법령 등과의 정합성의 문제를 해소하고자 한다. 셋째, 이 법의 채택은 그동안 북한의 노동관계법령은 대내외 경제부문을 구분하여 규정하고, 적용하는 정책을 고수해 왔는데, 이는 어쩌면 그동안 북한이 그동안 고수해 온 기조의 변화 가능성을 시사하고 있는 것이기도 하다. 따라서 이번에 채택된 북한의 ‘사회보험 및 사회보장법’의 법제적 의의와 함의, 기존 관련 법령들 및 노동관계법상 사회보험 및 사회보장제도의 변화를 규명하는 것은 북한법제 기초연구에서 뿐만 아니라 남북경제협력 및 통일법제의 기초 연구에서 매우 중요할 것으로 사료된다. 이 연구는 이러한 점을 반영하여, 사회보험 및 사회보장의 개념과 북한에서 최근 채택된 ‘사회보험 및 사회보장법’의 변화와 구체적인 내용 및 특징을 살펴보고, 노동관계법과 연계하여 그 변화를 분석해 보고자 한다.
Abstract
On March 3, 2021, North Korea held the 13th Plenary Meeting of the 14th Standing Committee of the Supreme People's Assembly of the Democratic People's Republic of Korea (DPRK) and adopted the ‘Law on Social Insurance and Social Security’. This law integrates the national social insurance system and the national social security system into one law, and aims to ease Kim Jong-un's efforts to transition to a 'socialist rule of law country' and to alleviate the financial burden caused by the economic hardship after the COVID-19 outbreak. In addition to other political purposes, such as boosting soldier morale and strengthening system solidarity by highlighting the spirit of love for the people, there are various implications related to the changes in the laws related to labor. First, by establishing a basis for raising social insurance funds from workers, inter alia, the regime seems to be attempting to alleviate the country's financial burden caused by the economic crisis after the coronavirus outbreak, and at the same time use these resources to provide support to not only general workers but also women, the elderly, children, and the disabled. This seems an attempt at establishing a type of universal social security. Second, before and after the adoption of this law, North Korea reorganized various social security-related laws to consider consistency with this law, while establishing detailed standards to comply with the social insurance and social security-related standards scattered about in the Constitution and various labor-related laws. So it is intended to resolve the problem of consistency with the Constitution and labor-related laws and regulations. Third, the adoption of this law suggests that North Korea's labor-related laws and regulations have maintained a policy of separately defining and applying domestic and foreign economic sectors, which may indicate a possible change in the policy that North Korea has maintained so far. Therefore, identifying the legal significance and implications of North Korea's recently adopted 'Law on Social Insurance and Social Security', existing related laws, and changes in the social insurance and social security system is not only important for basic research on the North Korean legal system, but also for inter-Korean economic cooperation—especially in basic research that may contemplate a future unified legal system for the two Koreas. This study examines the concepts of social insurance and social security and the changes and specific contents and characteristics of the 'Law on Social Insurance and Social Security' recently adopted in North Korea, and analyzes the changes in connection with the labor laws.
