현행 변호사시험 제도가 법학 교육에 미치는 영향 : 법전원의 입시학원화와 법전원 교육의 파행화

초록
우리나라 법학전문대학원의 법학 교육이 작금의 파행을 겪는 이유는 단순히 법학전문대학원 졸업생들만을 대상으로 한 ‘시험에 의한 법조인 양성체계’가 잘못되었기 때문은 아니다. 변호사시험 자체를 충실히 준비하도록 함으로써 법조인 양성에 도움이 된다면 법학전문대학원이나 법학전문대학원생들의 과열된 시험 준비 양상 자체를 탓할 수 없고, 시험 준비가 사교육의 도움을 받아 완성하였다고 하여 그조차 무시하거나 경시할 것도 아니기 때문이다. 과거 사법시험 준비 시대의 법과대학에서의 법학 교육 체제가 절대 법학전문대학원의 그것에 비하여 반드시 우위에 있던 것이 아니라는 현실은 결국 대학과 대학원에서의 법학 교육이라는 것은 변호사 자격증 취득과 무관할 수 없고, 전문대학원 체제에서의 법학 교육은 시험 준비에 영향을 받을 수밖에 없다는 측면을 다시 자각하게 해 준다. 하지만 법학전문대학원에서의 법학 교육은 기본적으로 실무에서 통용되는 분야에 대한 교육이 될 수밖에 없고, 따라서 기초법학은 외면받을 수밖에 없는 현실에 직면하게 된다. 결국 위에서 언급한, 변호사시험 제도를 수정함으로써 법학전문대학원에서의 법학 교육의 파행을 개선하고자 하는 노력은 종국적으로는 변호사시험의 자격시험으로써의 성격이 실현화됨과 동시에 변호사시험의 개혁을 통하여 실무상 활용 가능한 일정 수준의 법적 소양을 법학전문대학원에서의 법학 교육을 통하여 갖춘 법조인만이 변호사시험을 통과하도록 함으로써만 가능한 것으로 사료된다.
Abstract
The reason why legal education at Korean law schools is disrupted is not simply because the “test-based legal professional training system” at the law schools is patently wrong. If faithfully preparing for the test itself helps to cultivate legal professionals, it cannot be blamed for the preparation for the test itself, and it does not mean that even the preparation for the test with the help from private education could not be in contempt. The reality that the legal education system at law colleges in the era of preparation for the judicial examination in the past was not necessarily superior to that of law schools at law schools. Law schools as professional schools should be the place for the preparation for the exam, and such reality cannot be overlooked. However, at the same time, efforts to change the disruption of legal education at current Korean law schools by revising the bar exam system mentioned above are believed to be possible only by allowing only legal professionals with a certain level of legal knowledge to pass the bar exam while realizing the true purpose of of the bar exam, letting the students prepared for the real world.
