장애인의 화장실 접근권 보장을 위한 시론(試論)

초록
화장실은 보편적인 공간이면서도, 그 사회의 소수자에 대한 특수한 문화와 이념을 반영한다. 소수자 중 장애인의 여러 접근권에 관해 최근 논의가 있지만 ‘화장실 접근권’에 관한 구체적인 논의는 낯설다. 본 연구는 장애인의 화장실 접근권이 놓인 법적 토대와 현행 법제를 분석하였고, 관련 문헌을 폭넓게 소개하였다. 장애인의 화장실 접근권은 시설 접근권의 일환이기도 하지만 화장실에 관한 고유한 쟁점이 존재하고, 인간으로서의 존엄과 가치뿐만 아니라 다양한 헌법상 근거를 갖는다. 이를 헌법상 기본권으로 바라본다는 것은, 화장실 접근권 보장 요구를 체계적으로 정당화함으로써 전문적인 법적 규제를 마련하고 구제수단의 실효성을 제고한다. 접근성, 무장애, 보편적 설계 등을 고려하여 권리를 제도화할 필요가 있다. 공중화장실은 물론 주택 내 화장실에 대한 관심도 필요하다. 주택과 비주택을 불문하고 건축설계 관련 법령에는 화장실에 관한 규율 자체가 거의 없다. 보편적 설계 개념이 건축 단계부터 확대될 필요가 있다. 장애인복지법은 접근권 보장의 토대를 형성하지만 그 구체화가 더 중요하다. 공중화장실법은 화장실 운영 전반을 국가 및 지방자치단체의 재량에 의존하고 있다. 장애인등편의법은 핵심적인 법률이지만 적용 대상이 지나치게 좁다. 최근 헌법소원의 보충성 요건 문제로 인해 장애인차별금지법상 권리구제의 중요성은 더욱 커졌다. 장애인권리협약의 경우 선택의정서 비준에 따른 구제절차가 이목을 끈다. 법령 외에 편의시설 상세표준도와 같은 매뉴얼도 중요하다. 요컨대 현행 법제는 그 적용 대상이 한정적이고, 하위규범이 불완전하며, 제도의 운영을 지방자치단체 등의 재량에 의존하고 있다. 비용을 이유로 현실을 방치한다면 장애인의 화장실 접근권이 권리로서 보장된다고 볼 수 없으므로, 국가 등은 과감한 금융 지원 등을 통해 건물의 개축 등을 유도해야 한다. 인류는 불과 수십 년 전까지도 변변한 수세식 화장실을 쓰지 못했다. 장애인의 화장실 접근권 또한 꾸준한 연구와 실천이 있다면 큰 변화를 맞이할 수 있을 것이다.
Abstract
Toilets, or restrooms, are universal spaces, but they also reflect the particular culture and ideology of a society’s minorities. Although various types of rights to accessibility for people with disability have been discussed recently, but the specific discussion on ‘right to access toilets’ is unfamiliar. This study analyzed the legal foundation and current legislation on which the right to access toilets for people with disability rests, and introduced related literature. While the right to access toilets for people with disability is part of the right to access facilities, there are unique issues related to toilets, and it has various constitutional grounds as well as human dignity, worth and the right. Viewing it as a fundamental constitutional right provides a systematic justification for the demand to ensure the right, thereby creating specialized legal regulation and enhancing the effectiveness of remedies. It is necessary to institutionalize the right in terms of Accessibility, Barrier-free and Universal Design. Attention needs to be paid to toilets in housing as well as public toilets. Building design codes, both residential and non-residential, are largely silent on toilets. The concept of universal design needs to be expanded from the construction stage of buildings. The ACT ON WELFARE OF PERSONS WITH DISABILITIES forms the foundation for ensuring the right access to toilets for people with disability, but its implementation is more important. PUBLIC TOILETS ACT relies too heavily on the discretion of national and local governments to manage toilets. The ACT ON THE GUARANTEE OF CONVENIENCE PROMOTION OF PERSONS WITH DISABILITIES is a key of legislation, but its scope is too narrow. With the recent problems of requirements for constitutional complaint, the importance of remedies under the ACT ON THE PROHIBITION OF DISCRIMINATION AGAINST PERSONS WITH DISABILITIES AND REMEDY AGAINST INFRINGEMENT OF THEIR RIGHTS is growing. In the Convention on the Rights of People with Disabilities, the remedies available upon ratification of the Optional Protocol draw attention. In addition to laws and regulations, manuals such as the Accessibility Standards are also important. In short, the current legal system is limited in scope, has no or poor sub-norms, and relies on the discretion of local governments to operate the system. If the reality is ignored due to cost, the right to access toilets for people with disability cannot be guaranteed as a right, so the government should provide bold financial support to encourage the renovation of buildings. Human beings didn’t have access to flush toilets until a few decades ago. The right to access toilets for people with disability can be greatly improved with continued research and practice also.
