초록
[연구목적]본 연구의 목적은 상속세에 관한 기존의 논점을 확장하여 상속세 납세협력의무를 이행하는 과정에서 합리적 과세체계로 개선하기 위한 방안을 제시하는 것이다. [연구방법]본 연구의 수행을 위해 문헌 연구와 실무사례 연구를 병행하였다. 문헌 연구 방법으로는 국내외의 학술지, 단행본, 학위논문 등을 수집, 분석하였고, 관련 법령상의 지출비용의 개념 및 이론적인 검토와 함께 관련된 실무사례를 분석하여 개선방안을 제시하였다. [연구결과]연구 결과, 본 연구에서 구체적으로 검토한 내용은 다음과 같다. 첫째, 상속으로 인해서 발생하는 실질적 지출비용들을 상속세 과세가액 산정과정에서 차감할 수 있도록 기존의 과세체계를 일부 수정하는 방안을 검토하였다. 둘째, 상속세법상 지출비용을 공제받지 못함으로써 발생하는 문제점을 보다 근본적으로 개선하기 위해 상속세 과세표준 산정과정에서 차감하는 방법을 검토하였다. [연구의 시사점]본 연구에서는 상속세 산정시 지출비용 등의 실질이 피상속인의 귀속지출에 해당하고, 대부분의 상속인들이 실질적인 부담을 하고 있다는 현실적 인식을 확인하고 개선안을 제시함으로써 관련 연구 및 실무 분야에 시사점을 제공할 것으로 기대된다.
Abstract
[Purpose]The purpose of this study is to expand existing research perspectives related to inheritance tax and to present reasonable tax system improvement alternatives that can faithfully fulfill tax cooperation obligations. [Methodology]In order to achieve the purpose of this study, an improvement plan was derived based on the current theoretical background and a literature review of related prior studies. [Findings]As a result of this study, the summary is as follows. First, we reviewed a plan to partially modify the existing taxation system so that actual expenses incurred due to inheritance can be deducted from the inheritance tax calculation process. Second, in order to more fundamentally improve the problems arising from not being able to deduct expenses under the Inheritance Tax Act, a method of deducting the inheritance tax from the calculation process of the tax base was reviewed. [Implications]In this study, an improvement alternative related to inheritance tax calculation was presented. This is expected to provide significant implications for related research and practice areas.
