인터넷에 의한 명예훼손의 준거법

초록

인터넷에 의한 명예훼손의 준거법 규칙을 정립하는 것은 쉬운 일이 아니다. 명예훼손의 사안에서는 일반 불법행위와 달리 표현의 자유와 평판의 보호라는 대립된 법익 간의 균형을 저촉법적 관점에서 고려하여야 하는 한편, 명예훼손이 인터넷에 의하여 이루어지는 경우 현실의 물리적 공간을 전제로 한 기존의 준거법 규칙을 그대로 적용하기 어렵기 때문이다. 인터넷에 의한 명예훼손의 사안에서 준거법 규칙을 확립하는 것이 어렵다는 점은 그에 관한 입법례가 매우 다양하다는 점에서도 드러난다. 단일한 준거법을 지정하는 방식으로 피해자의 상거소지법을 지정하는 방식, 피해자의 주소지법을 지정하는 방식, 발행지법을 지정하는 방식이 있고, 복수의 준거법을 지정하는 방식으로 결과발생지법 또는 발행지법 원칙을 채택한 방식, 피해자에게 준거법에 대한 선택권을 부여하는 방식, 관할근거에 따라 준거법을 지정하는 방식이 제시된다. 최근에는 각국마다 상이한 인터넷에 의한 명예훼손의 준거법 규칙을 국제적으로 통일적으로 규율하고자 하는 노력의 일환으로 인터넷에 의한 명예훼손의 국제재판관할 및 준거법에 관한 조약을 제정하고자 하는 시도도 있다. 인터넷에 의한 명예훼손에 있어 검토가 필요한 연결점은 ① 법정지, ② 발행지, ③ 원고의 평판에 대한 손해가 발생한 국가, ④ 명예훼손적 게시물을 업로드한 국가, ⑤ 서버 소재지, ⑥ 피해자의 상거소지 또는 주소지이다. 법정지를 연결점으로 하게 되면 법정지 쇼핑(forum shopping)의 위험이 크므로 적절하지 않다. 발행지는 결과발생지 그 자체가 아니라 결과발생지가 되기 위한 전제로서의 의미를 지닐 뿐이고, 발행지를 연결점으로 하게 되면 인터넷에 의한 명예훼손적 게시물을 다운로드한 복수의 국가의 법을 모두 발행지법으로서 준거법으로 보게 되어 법률관계를 번잡하게 할 것이라는 점에서 적절하지 않다. 서버 소재지의 경우, 피고에 의하여 쉽게 조작 가능할 뿐만 아니라 예측이 불가능하고, 피고에게 일방적으로 유리하므로 연결점으로 하기에 타당하지 않다. 결국 인터넷에 의한 명예훼손의 준거법으로 인정하기에 적절한 연결점은 ① 명예훼손적 게시물을 업로드한 국가(행동지), ② 원고의 평판에 대한 손해가 발생한 국가(결과발생지), ③ 피해자의 상거소지이다. 원고의 평판에 대한 손해가 발생한 장소는 결과발생지로서, 발행 당시 제3자가 명예훼손적 게시물을 다운로드한 시점의 그 제3자의 상거소지국일 것이다. 다만 합리적인 제3자라면 해당 게시물이 원고의 평판에 영향을 주지 않을 것으로 생각하였다면 원고의 평판에 대한 손해가 발생한 국가로 볼 수 없다. 한편 피해자의 상거소지는 대체로 인격권 침해의 결과발생지로서 가장 심한 침해가 발생하는 곳이고 원고의 평판을 형성하는 데 있어 가장 중요한 관련을 가지는 곳이다. 개정 국제사법은 인터넷에 의한 명예훼손의 준거법에 관한 특칙을 두고 있지 않으므로 불법행위의 준거법에 관한 개정 국제사법 제52조가 적용된다. 개정 국제사법 제52조 제1항의 행동지법은 서버 소재지법이 아니라 ‘명예훼손적 게시물을 업로드한 국가의 법’으로 해석해야 하고, 결과발생지법은 발행지국법이나 인터넷상 명예훼손적 게시물에 접속 가능한 모든 국가의 법이 아니라 ‘원고의 평판에 대한 손해가 발생한 국가의 법’으로 해석해야 한다. 개정 국제사법 제52조 제1항은 결과발생지에 대한 예견가능성에 의한 제한을 인정하지 않으나, 표현의 자유라는 측면을 고려한다면 목적론적 축소에 의하여 예견가능성이 없는 결과발생지의 법을 개정 국제사법 제52조 제1항의 결과발생지법에서 해석상 배제할 수 있다고 본다. 결과발생지법의 적용범위는 그 국가에서 발생한 손해에 한정되는 것으로 보아야 할 것이다. 한편 개정 국제사법 제52조 제2항 내지 제4항, 제53조도 인터넷에 의한 명예훼손의 준거법을 정함에 있어서 적용될 것이나, 종속적 연결에 따라 인터넷에 의한 명예훼손 사안과 아무런 관련이 없는 준거법이 지정될 경우 예외조항인 제21조의 적용에 의하여 배제될 수 있다고 본다. 인터넷에 의한 명예훼손의 준거법을 정함에 있어서는 표현의 자유와 명예의 보호라는 법익을 저촉법적 관점에서 공평하고 균형있게 고려해야 한다는 점에 비추어 보면 특칙을 둘 필요가 있다. 본 논문에서는 인터넷에 의한 명예훼손의 준거법 규칙을 정립함에 있어서 인터넷에 의한 명예훼손의 준거법이 되기에 적절하다고 본 ① 명예훼손적 게시물을 업로드한 국가의 법(행동지법), ② 원고의 평판에 대한 손해가 발생한 국가의 법(결과발생지법), ③ 피해자의 상거소지국법 중 ②를 우선적으로 적용하되 가해자의 예견가능성을 요구하고, ①과 ③을 택일적으로 연결하는 방안을 제시하였다. 본 논문에서 제시한 준거법 규칙 외에 다른 방안도 생각해 볼 수 있을 것이나, 어떠한 준거법 규칙을 정립하든지 명확성, 예측가능성과 함께 인터넷의 특성, 표현의 자유와 평판의 보호에 대한 균형적 고려가 있어야 할 것이다.

Abstract

Establishing the choice of law rules for defamation via the Internet is not an easy task. In the case of defamation, unlike general torts, the balance between the conflicting legal interests of freedom of expression and protection of reputation must be considered from the perspective of conflict of laws. Moreover, while when defamation is committed over the Internet, it is difficult to apply conflict of law rules based on the premise of physical space premised on reality. The difficulty of establishing conflict of law rules in cases of Internet defamation is also revealed in the fact that legislation in each country varies greatly. There are ways to designate a single governing law, such as (ⅰ) the law of the victim’s habitual residence, (ⅱ) the law of victim’s address, and (ⅲ) the law of the place of publication. Ways of designating multiple governing laws may include: (i) a method of adopting the principle of the law of the place of occurrence or the law of the place of publication, (ⅱ) a method of giving victims a choice regarding the governing law, (ⅲ) a method of designating the governing law according to the basis of jurisdiction. Recently, there has been an attempt to enact a treaty on the international jurisdiction and governing law of defamation through the Internet as part of an effort to uniformly regulate the governing law of Internet defamation, which differs in each country. The connecting factors that require review in Internet defamation are (ⅰ) the forum, (ⅱ) the place of publication, (ⅲ) the place where damage to the plaintiff’s reputation occurred, (ⅳ) the place where the defamatory post was uploaded, (ⅴ) the server location, (ⅵ) the victim’s habitual residence or address. Using the forum as a connecting factor is not appropriate because there is a high risk of forum shopping. The place of publication is not the place of occurrence itself, but merely a prerequisite for the place of occurrence. If the place of publication is used as a connecting factor, the laws of multiple countries where defamatory posts from the Internet have been downloaded are all viewed as the governing laws as the laws of the place of publication, and it will complicate legal relations. In case of a server location, it is not only easily manipulated by the defendant, but also impossible to predict, and is unilaterally advantageous to the defendant. For this reason, it is not appropriate to view the server location as a connecting factor. In the end, the appropriate connecting factors to be recognized as the governing law of Internet defamation are (ⅰ) the place where the defamatory post was uploaded (place of action), (ⅱ) the place where damage to the plaintiff’s reputation occurred (place of occurrence), and (ⅲ) the victim’s habitual residence. The place where damage to the plaintiff’s reputation occurred is the place of occurrence, which would be the country of habitual residence of the third party when the third party downloaded the defamatory post. However, if a reasonable third party thought that the post would not affect the plaintiff’s reputation, the place cannot be considered as the place in which damage to the plaintiff’s reputation occurred. On the other hand, the victim’s habitual residence is generally the place where the most severe infringement occurs, and where it is most important in forming the plaintiff’s reputation. Since the Revised Korean Act of Private International Law(hereinafter “KOPIL”) does not have any special rules regarding the governing law of Internet defamation, KOPIL Article 52 on the governing law of torts applies. The law of the place of action in Article 52, Paragraph 1 of KOPIL should be interpreted as ‘the law of the country where the defamatory post was uploaded’ rather than the law of the server location. The law of the place where the result occurred in Article 52, Paragraph 1 should be interpreted as ‘the law of the country where damage to the plaintiff’s reputation occurred’ rather than the law of the country of publication or the law of the country where the defamatory post was uploaded on the Internet. KOPIL Article 52, Paragraph 1 does not recognize restrictions based on foreseeability of the place of occurrence, but considering the aspect of freedom of expression, the law of the place of occurrence cannot be foreseen should be excluded through teleological reduction. The scope of application of the law of the place of occurrence should be viewed as limited to damages that occurred in that country. Meanwhile, Article 52, Paragraphs 2 to 4, and Article 53 of the KOPIL will also be applied in determining the governing law of Internet defamation. However, if a governing law that has nothing to do with the Internet defamation is designated due to a subordinate connection, it is believed that it can be excluded by application of Article 21 of the KOPIL. In determining the governing law for Internet defamation, it is necessary to establish special rules in light of the fact that the legal interests of freedom of expression and protection of reputation must be considered fairly and balanced from the perspective of conflict of law. In this paper, (ⅰ) the law of the country where the defamatory post was uploaded (the law of the place of action), (ⅱ) the law of the country where damage to the plaintiff’s reputation occurred (the law of the place of occurrence), (ⅲ) the law of the country of the victim’s habitual residence are deemed appropriate to become the governing law for Internet defamation. In establishing the conflict of law rules for Internet defamation, (ⅱ) was applied preferentially, but foreseeability of the perpetrator required, and a method of alternatively connecting (ⅰ) and (ⅲ) was proposed. Other methods than the conflict of law rules presented in this paper may be considered, but whatever conflict of law rules are established, there must be a balanced consideration of clarity and predictability, as well as the characteristics of the Internet, freedom of expression, and protection of reputation.
