북한의 「제대군관생활조건보장법」에 대한 분석: 서비스 내용을 중심으로

The purpose of this study is to analyze and derive the characteristics of the service of the Discharged Military Living Conditions Guarantee Act in North Korea. As for the analysis method of the study, a literature search technique was attempted through comparison with other laws and regulations. In the order of description of the study, first, the normative structure of the law was considered. Next, the service content of the Act was examined. Finally, the issue, evaluation, and implications of the Act were reached. As a result of the study, first, the law has a clear legal identity as it targets discharged generals and military officers. Second, the law contains the standards and contents of basic living services that North Korea thinks. Third, there are differentiated attitudes and tendencies rather than newly discovered issues and problems in the Act. Fourth, this statute has no conflict with other existing statutes in terms of functionality and content. On the other hand, the reason why we should pay attention to this statute is as follows. First, as this statute is a welfare statute enacted in the Kim Jong-un era, which is the most recent in terms of time, it is a statute that reflects North Korea's welfare awareness and service standards. Second, it is the first welfare law targeting discharged military officers, a special class in North Korea. This statute shows the standards for benefits and consideration for the core class recognized by North Korea. Third, since the Act is based on the livelihood security service, it can be applied to all residents. Therefore, it would not be unreasonable to change the main target of this law to North Korea's 'Act on Guarantee of Living Conditions for Residents'.
