공공의료기관에서의 민간투자 활용에 관한 비교법적 연구 - 한국과 일본의 법제 비교를 중심으로 -

공공의료기관은 국가 및 지방자치단체, 기타 공공단체가 설립하고 운영하는 의료기관, 평상시에는 국민에게 낮은 의료비로 의료 서비스를 제공하고, 감염병, 재난 등으로 인명 피해가 발생했을 때 적극적으로 대처하는 중요한 역할을 하여 왔다. 이렇게 중요한 역할을 하는 공공의료기관은 부족한 공공의료기관의 숫자와 심각한 노후화 현상이 동시에 발생하고 있다. 그러나 공공의료기관의 추가적인 설립과 노후화 문제를 동시에 대응하기에는 국가 및 지방자치단체의 재정이 부족하기 때문에, 공공의료기관에 민간투자사업을 활용하고 있는 사례가 늘어나고 있다. 이렇게 공공의료기관 민간투자사업이 증가하고 있음에도 불구하고, 현재 한국에서는 시설 건설을 필수적으로 요구하는 BTL방식 이외에는 다른 방식들은 활용되고 있지 않아 노후화에 효과적으로 대처하고 있다고 보기는 어렵다. 이와 같은 상황에서, 보다 적절하게 공공의료기관과 관련된 문제에 대응할 수 있도록 한국과 비슷한 민간투자법제를 가지고 있는 일본 민간투자법제와 비교하여 시사점을 도출하고자 한다. 일본은 「민간자금 등의 활용에 의한 공공시설 등의 정비 등의 촉진에 관한 법률」(民間資金等の活用による公共施設等の整備等の促進に関する法律)(이하 PFI법이라 한다)에 따라 민간투자사업이 실시되고 있다. 일본의 공공의료기관 민간투자사업은 2023년 10월 기준으로 15개 사업이 추진 중이며, BTL 방식에 해당하는 BTO+서비스 구입형 방식 이외에도, 개량운영형 방식에 해당하는 RO방식과, 개량 및 증설을 동반하지 않는 운영형 방식인 O방식 등 다양한 사업 방식을 활용하고 있다. 일본의 공공의료기관 민간투자사업은 개량운영형 방식, 운영형 방식, 결합형 방식 등 다양한 사업 방식을 활용하고 있어 각 공공의료기관의 사정에 맞게 사업을 실시할 수 있다는 점에서 시사점을 얻을 수 있다. 이러한 일본 공공의료기관 민간투자사업에서 다양한 사업방식이 활용되는 점은 현재 한국에서 공공의료기관 민간투자사업에 적용되는 사업 방식이 제한적이라는 한계를 보완할 수 있는 장점이 있다. 이와 같이 일본의 법제를 참고하여 다양한 사업 방식을 도입함으로써 공공의료기관 민간투자사업을 활성화하는 효과를 기대할 수 있다. 또한 이렇게 공공의료기관 민간투자사업이 활성화됨으로써 일반 국민과 사회 취약 계층에게 질 높은 의료 서비스를 안정적으로 제공하고, 코로나19 팬더믹과 같은 재난 상황에 적절하게 대응할 수 있는 효과가 기대된다.
Abstract
Public hospitals have played an important role in providing medical services to the public at low medical costs and actively responding to human damage caused by infectious diseases and disasters. The number of public hospitals that play such an important role is insufficient and a serious aging phenomenon occurs at the same time. However, there are increasing cases of using Private Finance Initiaitve(PFI) in public hospitals because the finances of the state and local governments are insufficient to cope with the additional establishment and aging of public hospitals at the same time. In this situation, we would like to draw implications by comparing it with the Japanese Private Finance Initiaitve(PFI) legal institutions, which has a similar private investment legislation to Korea, so that we can respond more appropriately to problems related to public medical institutions. In Japan, Private Finance Initiaitve(PFI) projects are being implemented in accordance with the Act on Promotion of Private Finance Initiative in . As of October 2023, 15 Private Finance Initiaitve(PFI) projects for public hospitals in Japan are being promoted, and in addition to the Build-Transfer-Operate(BTO) + service purchase scheme corresponding to the Build-Transfer-Lease(BTL) scheme, various business schemes are used, such as the Rehabilitate-Operate(RO) scheme corresponding to the improved operation method and the Operate(O) scheme, an operation method that does not accompany improvement and expansion. Japan's Private Finance Initiaitve(PFI) projects in public hospitals use a variety of business methods, including improved operation methods, operation methods, and combination schemes, which can have implications in that they can be carried out according to the circumstances of each public hospitals. The use of various business schemes in these Private Finance Initiaitve(PFI) projects in Japanese public hospitals has the advantage of supplementing the limitation that the current business scheme applied to private investment projects in public hospitals in Korea are limited. By introducing various business methods by referring to Japanese legislation, the effect of revitalizing private investment projects in public medical institutions can be expected. In addition, the revitalization of Private Finance Initiaitve(PFI) projects in public hospitals is expected to provide high-quality medical services to the general public and the vulnerable in society and respond appropriately to disasters such as the COVID-19 pandemic.
