Among the powers of the U.S. Federal President, the right to veto legislation exists as a check on the Federal Assembly. Unlike Korea, the U.S. federal government has no right to submit legislation, so it is a very important authority to check the Federal Assembly. The U.S. Federal President's right to reject legislation comes in two types: return veto and pocket veto. The need for a so-called “partial veto or line item veto” has been constantly controversial because there is a concern that the federal government's fiscal system may not operate normally due to the exercise of the veto power of the U.S. Federal President's budget bills. In addition, in reviewing the budget bills, the U.S. Congress is using the right to submit a budget named the so-called “earmark budget” to meet the financial needs of members of the Federal Assembly. In order to determine what this note budget means in terms of the allocation, checks and balances of fiscal powers of the Federal President and the Federal Assembly, it is necessary to examine the relationship between the Federal President's partial veto or line item veto power. Attention is focusing on whether the federal president will be granted some veto or line item veto power at a time when the important separation of powers, such as the need for federal president's control or checks on the federal parliament's budget bills, is inevitable.
