초록
현재 우리나라에서 국회, 법원, 헌법재판소, 선거관리위원회 등과 같이 행정부가 아닌 국가기관들의 사이버안보 문제에 관하여 그러한 기관들과 행정부 간 협력적 관계가 충분한 수준의 제도적 뒷받침이 되어 있다고 하기 어려운 점이 없지 않다. 그러한 문제 인식을 바탕으로 하여 행정부 외 헌법기관 사이버안보를 위한 행정부 역량 활용의 필요성을 확인하고 미국의 관련 사례를 검토하였다. 미국의 사례를 살펴보면 입법부, 사법부 등이 사이버안보를 위하여 행정부의 역량을 활용하는 노력을 다양하게 전개하고 있으며, 향후 우리나라의 제도 발전 과정에서 이러한 사례들을 참고할 수 있을 것이다. 그리고 헌법학적 관점에서 행정부 외 헌법기관 사이버안보를 위한 행정부 역량 활용의 헌법적 근거와 원칙을 살펴보고 우리나라의 제도적 발전 방향을 모색하였다. 행정부 외 헌법기관 사이버안보를 위한 행정부 역량 활용은 권력분립에 의한 헌법기관의 독립성을 존중하고 헌법기관충실원칙을 준수하여 합헌적 권한의 범위 내에서 상호 협력과 지원 관계를 형성하는 것이 바람직하다. 이를 통하여 궁극적으로 국가의 기본적인 목적과 기능인 질서와 평화의 유지로서 국가안전보장을 위한 헌법기관의 과제를 달성할 수 있을 것이다.
Abstract
In Korea, there is not the sufficient level of legal system on cooperative relationships between executive branch and constitutional organs other than the executive branch for cybersecurity. It is demanded to utilize the executive branch’s capabilities for cybersecurity of constitutional organs. There are various efforts to utilize the capabilities of the executive branch for cybersecurity of another branches in the United States. These efforts can be referred to the development of Korea's legal system. In those utilizing, it is needed to respect the independence of constitutional organs by separation of powers. And it is necessary to comply with the principle of fidelity to constitutional organs and to make cooperation and support relationships within the scope of constitutional authority. It will make constitutional organs to achieve the task to ensure national security for maintaining order and peace, which is one of the basic purposes and functions of a state.
