인공지능과 알고리즘 관리에 대한 노동법적 규율 — 미국 바이든 정부의 AI 행정명령을 중심으로 —

Behind the many benefits and conveniences that AI has brought, there are also fears of job losses (employment) and violations of workers' protection and fundamental rights (labour). The United States has responded to this phenomenon, which the rest of the world is experiencing simultaneously, on many levels and in many ways. Individual government agencies have taken action against illegal AI uses, while labour unions have attempted to prevent misuse of AI through self-regulation, including collective bargaining. The US has not yet enacted a legal code in the form of legislation that directly and specifically regulates AI in the same way as the European Union. However, the Executive Order is significant in that it is the most comprehensive attempt to address AI, which is expected to be one of the most important technological developments of our time and one of the changes that could have the greatest impact on human civilisation as a whole. In this article, I briefly review the Executive Order's highlights and directives, particularly in the area of employment and labour, as well as the follow-up actions taken by individual government agencies, and consider the implications for our AI and algorithmic discipline. I hope that this article will contribute to the development of our own laws and policies for the issue of this era.
