북한이탈주민 대상 법교육의 현황과 개선 방향

초록
북한이탈주민을 대상으로 한 법률교육은 남한 사회의 정착을 위한 기초교육의 일환으로 시작되었다. 북한이탈주민이 남한에 성공적으로 정착하기 위해서는 남북의 법 체계 및 법치주의의 차이를 이해하고 극복해야 한다. 북한 이탈주민에 대한 제도적인 지원이 상당 기간 진행된 현재의 상황에서, 북한이탈주민에 대한 법교육도 다양한 형태로 변화하고 발전해 왔다. 그러나 여전히 남한 사회에 대한 이해와 적응을 위한 충분한 교육이 이루어지지는 못하고 있는 상황이다. 이 글은 북한이탈주민을 대상으로 실시되고 있는 법교육을 보다 체계적이고 실효적으로 실시할 수 있는 방향을 모색하는 것을 목적으로 한다. 이를 위해 우선 현재 실시되고 있는 북한이탈주민 법교육의 현황을 검토하여 한계와 개선할 점을 도출해 보았다. 그리고 이를 바탕으로 법교육 내용의 체계화, 북한이탈주민 유형에 따른 법교육 내용 다각화, 지역 정착 후 법교육 강화, 담당 기관의 유기적 협력과 전문교육 인력 양성 등 북한이탈주민의 성공적인 정착을 위해 필요한 법교육의 개선 방향을 제시하였다.
Abstract
Legal education for North Korean defectors began as part of basic education for their settlement in South Korean society. In order for North Korean defectors to successfully settle in South Korea, they must understand and overcome the differences in the legal systems and rule of law between North and South Korea. In the current situation, where institutional support for North Korean defectors has been in progress for a considerable period of time, legal education for North Korean defectors has also changed and developed in various forms. However, sufficient education for understanding and adaptation to South Korean society is still not provided. The purpose of this article is to seek ways to more systematically and effectively implement legal education for North Korean defectors. To this end, I first review the current status of legal education for North Korean defectors and derived limitations and areas for improvement. Based on this, A direction for improving education was presented that systematization of legal education contents, diversification of legal education contents according to types of North Korean defectors, reinforcement of legal education after settlement in the region, organic cooperation between responsible organizations and training of professional.
