직장 내 성희롱의 사각지대로서의 카페 산업

초록
여성들은 카페 산업의 대다수를 차지하는 핵심 집단이다. 하지만 이 여성들은 직장 내 성희롱과 관련해 체계적으로 고립되어 있다. 이러한 점에서 카페 산업이 직장 내 성희롱의 법적 사각지대로 위치하는 양상은 성평등 노동의 측면에서 비판적으로 분석될 필요가 있다. 이에 본 연구는 카페 산업에서 직장 내 성희롱이 누적된 배경으로서 법률의 한계 및 카페노동 현장에서 우선시되는 사용자 중심의 법 감정 수준을 다루고자 한다. 「남녀고용평등법」, 「양성평등기본법」, 「산업안전보건법」, 「고용보험법」 등은 직장 내 성희롱 예방 및 피해자 보호와 밀접한 관련이 있는 독자적 규정을 담고 있다. 그러나 상시근로자 10인 미만의 소규모 사업장 중심으로 편성되어 있는 카페에서는 위 법률들의 규정 준수 의무가 예외적으로 생략되거나실질적인 효력을 갖지 못한다. 따라서 본 연구는 직장 내 성희롱 관련 법률이 성희롱 예방 및 피해자 보호의 차원에서 실효성이 제한되는 바를 구체화한다. 이를 바탕으로 카페를 비롯해 직장 내 성희롱의 법적 사각지대에 위치한 산업 분야, 특히 고객 응대 업무를 중심으로 하는 소규모 사업장에 대한 적극적개선 조치가 시급하다는 점을 피력하고자 한다.
Abstract
Women are the core group that makes up the majority of the cafe industry. However, these women are systematically isolated from workplace sexual harassment. In this regard, the structure of the cafe industry as a legal blind spot for workplace sexual harassment needs to be critically analyzed from the perspective of gender equality labor. Accordingly, this article aims to address the limitations of the law and the level of legal judgment that is prioritized in the workplace of cafes as the background of the accumulated sexual harassment in the cafe industry. The Equal Employment Opportunity Act, the Basic Act on Gender Equality, the Industrial Safety and Health Act, and the Employment Insurance Act contain independent regulations that are closely related to the prevention of sexual harassment in the workplace and the protection of victims. However, in cafes, which are mainly small businesses with less than 10 regular employees, the obligation to comply with the regulations of the above laws is exceptionally omitted or has no practical effect. Therefore, this article specifies the limitations in the effectiveness of laws related to sexual harassment in the workplace in terms of the prevention of sexual harassment and the protection of victims. Based on this analysis, this article aims to emphasize the urgent need for active improvement measures for industries that are in the legal blind spot of sexual harassment in the workplace, including cafes, especially small businesses that focus on customer service work.
