도심항공교통(UAM) 운항을 위한 법제적 검토

초록
국토교통 산업의 혁신을 통해 4차 산업혁명 시대의 미래 먹거리로 육성하고 역동적 경제성장 지원을 과제목표로 설정하였으며, 이에 따라 국토교통부는 2025년 도심항공교통 상용화를 위해 C-ITS, 정밀도로지도, 버티포트, 맞춤형 기상정보 등 인프라와 법․ 제도, 시범운행지구 지정 등 실증기반을 마련하고, 산업통상자원부는 친환경·지능형 모빌리티 전환 촉진을 위한 기업생태계 조성을 위해 도심항공교통 제조산업을 육성하여 혁신기반을 강화하고 있다. 도심항공교통은 도시인구집중현상으로 인하여 주거, 환경적인 요소와 복합적으로 작용하여 사회적 비용을 예측하기 어려운 실정에 이르렀다. 도심항공교통은 기존 교통수단에 비해 통행시간을 절감하고 교통수요의 분산으로 교통혼잡을 감소시키며 전기 등 친환경 기술이 적용된 기체를 개발하여 탄소배출량을 감소하는 등 교통편의성과 주거, 환경적인 측면에서 혁신적이고 지속가능하다는 장점이 있다. 「도심항공교통 활용 촉진 및 지원에 관한 법률」이 2023년 11월 24에 제정되어 올해 4 월 25일 시행되었고 같은 법 시행령이 같은 해 5월 27일, 같은 법 시행규칙이 같은 해 4월 25일 시행되었으며 최근 2024년 6월 10일에는 서울 송파구 잠실헬기장에서 도심항공교통 통합교통서비스(MaaS) 플랫폼을 준비하고 있는 모비에이션의 새로운 모빌리티 ‘본에어’ 운송 서비스가 공개됨에 따라 도심항공교통의 상용화가 눈앞에 다가왔다. 이에 따라 「도심항공교통 활용 촉진 및 지원에 관한 법률」과 현행 항공법령체계와 도심항공교통의 운항 시 선결문제에 있어서 신유형의 항공기에 대한 등록문제, 안전운항을 위한 증명, 항행안전시설에 대한 검토 및 UAM 운항 노선의 재산권 문제와 버티포트시설 설치에 따른 빛, 소음, 조류 피해 등에 대한 검토하고 끝으로 UAM 사고 보고에 대해 법제적 검토가 필요함을 확인할 수 있다.
Abstract
The Ministry of Land, Infrastructure, Transport and Tourism is establishing infrastructure, laws and systems, and designation of pilot zones for commercialization of urban air traffic in 2025, and the Ministry of Trade, Industry and Energy is strengthening urban air traffic manufacturing. Urban air transportation has become difficult to predict social costs as it works in combination with residential and environmental factors due to the concentration of urban population. Urban air traffic has the advantage of being innovative and sustainable in terms of transportation convenience, housing, and environmental aspects, such as reducing traffic time, reducing traffic congestion due to distribution of traffic demand, and reducing carbon emissions. The Act on the Promotion and Support of Urban Air Traffic Utilization was enacted on November 24, 2023, took effect on April 25, 2023, the enforcement rules of the Act took effect on May 27, 2024, and the commercialization of urban air traffic is imminent. Accordingly, it is necessary to review the registration of new types of aircraft, certification for safe operation, property rights issues at UAM destinations, and damage to light, noise, and tide due to the installation of UAM facilities.
