본 연구에서는 우리나라 CCUS 법정책이 CCUS 기술 개발과 관련하여 고려해야 할 사항에 대해 살펴보았다. CCUS 기술은 이산화탄소의 열역학적, 농도, 지질학적 특성을 반영하여 개발되는 중으로, 우리나라는 국가 온실가스 감축목표 달성을 위해 CCUS 기술을 적극적으로 도입하고자 관련 법정책을 추진 중에 있다. 다만 CCUS 기술은 지속가능한 에너지 혁신 기술로서, 우리나라 법정책이 CCUS 기술의 혁신 속도, 잠재적 리스크나 편익을 반영하지 못하는 규제지체 현상이 발생할 우려가 있다. 이를 최소화하기 위해, 기존 기술과 새로운 혁신 기술을 차별하지 않는 것은 물론, 발생하는 리스크･편익을 관리할 필요가 있다. 구체적으로는 향후 다수의 이산화탄소 포집･수송･저장･활용 사업자가 상호작용하는 CCUS 거버넌스를 고려하여, 포집된 이산화탄소의 순도 기준을 설정하고, 수송 배관 표준을 설정하며, 영구저장은 물론 저장 후 활용 가능성도 고려하고, 경제성 확보를 지원하되 화석연료 산업의 과도한 사용기한 연장이 이루어지지 않도록 할 필요가 있다.
Abstract
This paper examines the considerations that Korea's CCUS legal policy should take into account in relation to the development of CCUS technology. CCUS technology is developed by considering the thermodynamic, concentration, and geological characteristics of carbon dioxide. And Korea is actively promoting related legal policies to actively implement CCUS technology to achieve NDC target. However, as CCUS technology is a sustainable energy innovation, there is a risk that Korea's legal policies may not reflect the pace of innovation, potential risks, or benefits of CCUS technology. To minimize this, it is necessary to not discriminate between existing technologies and new innovative technologies, as well as to manage the risks and benefits that arise. Specifically, considering the governance of CCUS, where multiple CO2 capture, transport, storage, and utilization operators will interact in the future; Set purity standards for captured CO2; Set standards for gaspipe; Consider the potential for permanent storage as well as post-storage utilization; Consider the economics of CCUS, while ensuring that the fossil fuel industry is not overextended.
