경찰의 이동형 영상정보처리 기기 운영에 따른 피규제자의 기본권 확보 방안 -「경찰착용기록장치 운영 등에 관한 규정」의 내용과 문제점을 중심으로 -

「개인정보 보호법」에 이동형 영상정보처리기기에 대한 규정이 신설되면서 경찰장비에 ‘경찰착용기록장치’를 포함하는 「경찰관 직무집행법」의 개정이 이어졌다. 그리고 그 운영에 대한 구체적 지침을 담은 「경찰착용기록장치 운영 등에 관한 규정」이 지난 2024년 7월 31일부터 시행되었다. 이미 여러 국가에서 경찰바디캠을 도입하여 국민과 사법기관 사이의 신뢰 회복과 증거보전 등의 목적으로 활용하고 있다. 그러나 경찰착용기록장치는 국민적 합의를 얻어 경찰작용에서도 폭넓게 활용되고 있는 고정형 영상정보처리기기(Closed Circuit TV)의 설치·운용과는 달리 보아야 할 필요가 있다. 왜냐하면 경찰착용기록장치는 넓은 범위의 촬영장소에서 피규제자를 근접 촬영하며 영상·음성기록을 남겨 관리하므로 피규제자의 기본권 침해 가능성이 훨씬 크기 때문이다. 따라서 경찰착용기록장치의 운영은 고정형 영상정보처리기기에 비하여 보다 엄격한 시각으로 보아야 한다. 이 연구에서는 「경찰관 직무집행법」상 그 사용이 허용된 경찰착용기록장치의 운영에 대하여 동법의 위임을 받아 구체적 지침을 규율하고 있는 「경찰착용기록장치 운영 등에 관한 규정」(대통령령)의 내용을 알아 본 다음, 과연 동 규정이 위임입법의 한계를 준수하고 있는지 여부를 고찰한다. 또한 동 규정이 피규제자의 기본권을 정당하게 확보하고 있는지 여부에 관하여 살펴본 후, 피규제자의 기본권을 보다 안정적으로 확보하기 위한 개선방안을 제시하고자 한다.
Abstract
Following the revision of the "Police Officer Duty Execution Act," which includes a "police-wear recording device" in police equipment, the National Police Agency announced a legislative decree on the operation of the so-called "police body cam," which includes specific guidelines for the operation of the so-called "Police-Worn Body Cameras" Several countries have already introduced police body cameras and are using them for the purpose of restoring trust between the people and judicial institutions and preserving evidence. However, unlike the installation and operation of CCTV (Closed Circuit TV), which is widely used in police activities with public consensus, the operation of police recording devices that take close photos of regulated persons in a wider range of filming locations allowed under the CCTV 「Personal Information Protection Act」 should be viewed differently. In this study, I would like to examine whether the legislation legitimately secures the basic rights of the regulated person within the scope entrusted by the law and identify improvements for stable operation in the future.
