북한이탈주민 법률지원 개선방안 및 범죄예방 대책 연구
A Study on Improvement of Legal Assistance and Crime Prevention Measures for North Korean Defectors

본 연구는 북한이탈주민들이 대한민국 사회에 안정적으로 정착할 수 있도록 법률 지원 방안을 모색하고, 범죄 및 범죄 피해 예방을 위한 대책을 검토하는 데 목적이 있다. 북한이탈주민들은 경제적 빈곤과 심리적 불안정, 그리고 법률 지식의 부족 등으로 인해 범죄에 연루되거나 피해를 입을 가능성이 높다. 그러나 이들은 법률적 도움이 필요한 상황에서 적절한 지원을 받지 못하는 경우가 많아, 이들에 대한 실질적 법률 조력 체계를 구축하는 것이 시급하다. 탈북민들이 형사절차에서 자신들의 권리를 적극적으로 보호하고 또 재범을 예방 할 수 있는 법적 기반 마련에 대해 살펴보기 위해, 이 글은 먼저 북한이탈주민 대상 법률지원 현황을 사법지원제도와 법률교육제도로 나누어 검토한다. 또한 법률 지원 시 고려해야 할 탈북민들의 특성에 대해서도 이어서 검토한다. 그 이후 형사절 차의 전 과정을, i) 자유인이 범죄에 연루되어 형사절차를 거치게 되는 ‘제1신분 전환 시점’과, ii) 신체적 구금을 수반하는 형의 집행이 종료된 수형자가 다시 형사절 차로부터 자유로워지게 되는 ‘제2 신분전환 시점’으로 나누어 각 단계별로 지원 가능한 법률지원의 방법을 검토한다. 이때 북한이탈주민이 실제로 각 절차에서 겪는 어려움을 바탕으로 법률지원 수요를 파악하기 위해, 사단법인 북한인권시민연 합이 내부 연구자료로 활용하기 위해 작성한 2023년 9월 실시 설문조사 결과 및 같은 해 11월에 작성한 “범죄연루 탈북민 심층면접 요약서”를 동 기관의 허가를 얻어 함께 참조한다. 현행 북한이탈주민 대상 사법지원은 산재되어 있는 법률상담 시스템과 각 주체 간 협업 미비로 도움이 절실히 필요한 시점에 신속한 법적 조력을 제공하지 못한다 는 문제점이 있다. 또한, 현행 법률교육은 거의 모두 입국 초기 하나원 수용 상태에서 이루어져 북한이탈주민이 기초적인 법률 상식을 충분히 습득하기에는 한계가 있다. 이러한 문제점을 해결하기 위하여 ‘제1 신분전환 시점’에서는 i) 법률지원 주체 간 네트워크 형성 및 법률상담 핫라인 구축을 통한 맞춤형 지원 연계, ii) 형사공공변 호인제도의 도입, iii) 하나원 및 하나센터 법률교육의 개선이 필요하다. ‘제2 신분전 환 시점’에서는, 출소 탈북민의 사회적응 및 자립을 돕기 위하여 i) 한국법무보호복지 공단의 출소자 지원 프로그램 내용의 적극 홍보, ii) 북한이탈주민 출소자 쉼터 마련 방안 검토, 그리고 근본적으로는 iii) 신변보호담당관 제도의 개선이 필요하다.
Abstract
The purpose of this study is to explore ways to provide legal assistance to North Korean defectors to help them stably integrate into South Korean society, and to propose measures to prevent crime and prevent criminal victimization. North Korean defectors are more likely to be involved in or victimized by crime due to their economic poverty, psychological instability, and lack of legal knowledge. However, they often do not receive adequate support in situations where they need legal assistance, and it is urgent to establish a practical legal aid system. In order to contribute to laying the legal foundation for North Korean defectors to actively protect their rights in criminal proceedings and prevent recidivism, this report examines the current state of legal assistance for North Korean defectors, dividing it into the judicial assistance system and the legal education system, and then examines the legal assistance available at each stage of the criminal process, including the “first status transition,” when a free person is involved in a crime and undergoes criminal proceedings, and the “second status transition,” when a prisoner is released from criminal proceedings after the execution of a sentence involving physical detention. The survey conducted in September 2023 and the "Summary of In-depth Interviews with North Korean defectors Involved in Crime" conducted in November of the same year, prepared by the Citizens' Alliance for North Korean Human Rights (NKHR) for internal research purposes, were used as foundational materials for the research, with the organization's permission, to estimate the demand for legal assistance based on the difficulties North Korean defectors actually experienced in each process. Much of the confusion experienced by North Korean defectors is linked to complex and difficult legal issues in South Korean society. In order to promote the successful reintegration of North Korean defectors, who have not been able to adapt smoothly to South Korean society and are becoming a socially disadvantaged group, this paper reviews the general contents of legal aid activities for North Korean defectors and outlines various support measures to prevent recidivism and crime prevention.
