북한의 사회주의법치와 유일영도체계 – 사회주의법제정의 개념과 체계를 중심으로 –

North Korean authorities began transplanting the concept of socialist rule of law into North Korean society by adapting the principle of 'rule of law' through the theory of constructing a socialist law-based state starting from the early 2000s. Especially since Kim Jong-un took power, North Korea has been intensifying socialist rule of law, initiating comprehensive legislative reforms across society and beginning to establish and refine legal systems and their frameworks. In this context, this study examines North Korea's state system and analyzes the concept of socialist rule of law, Consequently, this study found that the core concept of North Korea's socialist rule of law is the exclusive leadership of the Supreme Leader and the Party. Therefore, the establishment of the exclusive leadership system of the Supreme Leader and the Party is essential, not only in the substantive content of the law but also in the legislative system. In practice, despite the existence of the Supreme People's Assembly as the highest sovereign body in North Korea's legislative system, most laws and regulations are enacted by the Standing Committee of the Supreme People's Assembly, which is composed of a small elite group. Furthermore, the Standing Committee holds supervisory authority over legislative activities and is endowed with most of the powers necessary to effectively realize the exclusive leadership of the Supreme Leader and the Party. This study aims to analyze how North Korea's legislative system specifically contributes to the reinforcement of the exclusive leadership system under its "socialist rule of law", and thereby uncover the true meaning of the "rule of law" as understood in North Korea
