헌법상 지방자치 원리에 따른 자치경찰제의 개선방안

진정한 지방자치를 위해서는 해당 지역공동체 주민의 참여가 필수적이라고 할 수 있다. 입법자는 주민들이 실질적으로 지방자치에 참여할 수 있는 다양한 제도적 장치들을 마련해야 한다. 그 근거는 지방자치의 본질에서 찾을 수 있다. 자치경찰의 경우에도 보면 주민들이 직·간접적으로 참여하고, 주민에 의한 자치경찰이 되기 위해서는 그 본질을 주민자치에서 찾을 수밖에 없다. 자치경찰제의 본질은 지방자치단체가 경찰조직에 대한 권한과 책임을 갖고 주민 의 참여 하에 경찰조직을 운영하는 것을 내용으로 하는 것이 가장 핵심적인 제도의 내용일 것이다. 이러한 이원화 모델은 국가경찰과 자치경찰이 분리된 채로 지방자치 단체가 경찰조직과 운영에 대한 권한과 책임을 갖고 자치경찰사무를 수행하는 것이 다. 즉, 이원화 모델은 국가경찰조직과 자치경찰조직이 구분되는 것이 가장 기본적 인 전제조건이 된다. 이원화로 분권화된 자치경찰의 모형은 적어도 주민의 직접 선거에 의해 구성된 지방의회에서 자율적인 결정에 따라 자체 예산과 자체 인력으로 구성·운영되는 자치경찰기구를 조직하여야 한다. 이렇게 되면, 시·도지사인 자치단체장의 책임 하에 지역주민을 위한 자치경찰서비스를 제공하는 이원화 모델이 일원화 모델보다 지방자치 원리에 더 합치하는 모형이라고 할 수 있다. 결론적으로 자치경찰과 관련된 모든 것이 지방자치의 이념에 맞게 구성·운영되기 위해서는 기본적으로 기초자치단체에는 경찰권을 실제로 행사할 수 있는 자치경찰 대가 설치되어야 하고 지구대 등도 지방자치경찰로 두어야 할 것이다. 그리고 특히 자치경찰제에 있어서 경찰사무에 대한 전권한성과 자기책임성이 잘 보장될 수 있도 록 규범화되어야 할 것이다.
Abstract
It can be said that the participation of residents of the local community is essential for true local autonomy. Legislators should prepare various institutional mechanisms for residents to participate in local autonomy practically. The basis can be found in the nature of local autonomy. In the case of local autonomous police, in order for residents to participate directly or indirectly and become autonomous police by residents, their essence must be found in resident autonomy. The essence of the autonomous police system is that local governments have authority and responsibility for the police organization and operate the police organization with the participation of residents. In this dual model, when the national police and the autonomous police are separated, local governments have authority and responsibility for police organization and operation and perform autonomous police affairs. In other words, in the dual model, the most basic prerequisite is that the national police organization and the autonomous police organization are distinguished. The model of decentralized local autonomous police should organize an autonomous police organization composed and operated with its own budget and its own manpower in accordance with autonomous decisions in local assembly formed by direct elections of residents at least. In this case, the dual model that provides autonomous police services for local residents under the responsibility of the head of the local government, which is the mayor/governor, is more consistent with the principle of local autonomy than the unification model. In conclusion, in order for everything related to autonomous police to be organized and operated in accordance with the ideology of local autonomy, basic local governments should have an autonomous police force that can actually exercise police power, and an area patrol unit or police substation should also be established. And in particular, in the autonomous police system, it should be stipulated so that full authority and self-responsibility for police affairs can be well guaranteed.
