이상동기 범죄의 개념에 대한 연구

초록
우리나라에서는 대략 1년에 50건 정도의 이상동기 범죄가 발생한다. 이는 전체 범죄의 약 0.00003% 정도에 불과하다. 하지만 범행 동기를 이해하기가 어려워서 이를 예방하기가 매우 힘들다. 언뜻 보기에 이상동기 범죄는 아무나 닥치는 대로 공격해서 살해하고, 그러한 행동을 왜 했는지 이유를 납득하기도 어렵다. 언제 어디에서 다가올지 모르는 미지의 위험이 되어 사회적 공포를 조성한다. 이상동기 범죄 현상은 언론에서 먼저 주목하기 시작했다. 1990년대 말의 일이다. 이후 이들 범죄에 대한 다양한 연구가 시작되었다. 처음 이들 범죄는 묻지마 범죄로 지칭되었다. 수사기관에서는 범행동기를 이해하기가 어렵다는 점에 초점을 맞추어 이상동기 범죄라는 표현을 사용하기 시작하였다. 이들 범죄를 지칭하는 표현은 아직 통일 되지 않았다. 이들 범죄의 공통점은 대략 다음 두 가지를 내용으로 한다. ① 상식 수준에서 범행 동기를 이해하기가 어렵다. ② 가해자가 바로 그 피해자들을 공격했어야만 했는가에 대해서 이해하기도 어렵다. 간단하게 말하자면 동기의 이상성과 공격의 무차별성 두가지이다. 이처럼 이상동기 범죄는 이해하기가 어려운 범죄 유형이다. 바로 이 점 때문에 이상동기 범죄 또는 묻지마 범죄 등의 표현을 사용하거나 연구의 대상으로 삼는 일 자체를 해서는 안 된다는 주장도 나온다. 하지만 이상동기 범죄 특유의 원인을 찾아서 적절한 대응책을 마련하기를 포기하는 것은 곤란하다. 이상동기 범죄가 발생되는 과정을 살펴보면 대략 다음과 같은 4단계의 구조를 가지고 있다. ① 범인의 사회 부적응, ② 부적응의 원인이 자신이 아닌 사회 집단에 있다는 쪽으로의 합리화, ③ 부적응에 대한 분노 축적, ④ 분노 폭발로 인한 공격 행위. 이에 따라 이상동기 범죄란 ‘사회 집단에 적응하지 못한 사람이 자신이 적응하고자 했던 사회 집단에 대한 분노를 형성하고, 그 사회 집단에 대한 분노가 걷잡을 수없는 상태에 도달하여, 그 사회 집단 구성원들을 분풀이 차원에서 닥치는 대로 공격 하는 것’이라고 할 수 있다. 결국 이상동기 범죄의 근본적인 원인은 사회 부적응에서 찾을 수 있다. 사회 집단에 적응하지 못하는 사람 가운데 그에 따른 분노를 밖으로 폭발시키는 유형이 이상동기 범죄 행위자가 되는 것이다. 이들을 사전에 발견하고 폭발하지 않도록 대책을 마련해야 할 것이다.
Abstract
In Korea, approximately 50 crimes with a strage motive occur each year. This is only about 0.00003% of all crimes. However, it is very difficult to prevent these crimes because it is difficult to understand the motive of the crime. Crime with a strage motive is a crime in which someone is indiscriminately attacked and killed. It is also difficult to understand the reason for such an act. Crime with a strage motive creates social fear as an unknown danger that can come anytime and anywhere. The phenomenon of strange motive crimes first began to receive attention from the media in the late 1990s. Since then, various studies on these crimes have begun. At first, these crimes were referred to as random crimes. Investigative agencies began to use the expression strange motive crime. It focuses on the fact that it is difficult to understand the motive of the crime. The expression for these crimes has not yet been unified. The commonalities of these crimes are the strangeness of the motive and the randomness of the attack. In this way, strange motive crimes are a type of crime that is difficult to understand. This is precisely why some argue that we should not use the term motiveless crime or study it. However, we should not give up on finding the specific cause of crime with strage motive and devising appropriate countermeasures. If we examine the process by which crime with strage motive occurs, it has a roughly four-stage structure. ① The offender’s social maladjustment, ② rationalizing that the cause of the maladjustment is not him/herself but the social group, ③ accumulation of anger about the maladjustment, and ④ aggressive behavior due to the explosion of anger. Accordingly, crime with strage motive can be defined as 'a crime of a person who has failed to adapt to a social group forms anger toward the social group to which he/she tried to adapt, and when the anger toward that social group reaches an uncontrollable state, he/she attacks members of that social group as a way to vent his/her anger.’ Therefore, the fundamental cause of crime with strage motive can be found in social maladjustment. We should discover these in advance and devise countermeasures to prevent them from exploding.
