교육복지 법제의 동향과 과제

If the country wishes to realize social justice and equality, eliminate educational gaps, and practically realize citizens' right to receive education under the Constitution, the following matters must be considered in the direction and tasks of educational welfare policy. In other words, support for educational welfare policies must be pursued in the direction of pursuing the development of students' capabilities, and when implementing educational policies, they must be conducted in the direction of tolerance to overcome exclusivity and embrace diverse groups of students. And it should be directed to providing quality educational opportunities so that students can have meaningful learning experiences. In addition, because it is difficult for policy support for educational welfare to completely overcome the social disadvantages students face, it should be implemented in a way that guarantees a certain level of achievement that can be socially agreed upon. It is necessary to establish a legal system that serves as a legal basis for the implementation of educational welfare policies. The enactment of laws stipulating matters such as the obligations of the state and local governments for educational welfare, establishment of basic plans, and related systems serves as the basis for promoting stable and effective policies for educational welfare. Currently, the mandatory provisions of national and local governments to implement educational welfare policies stipulated in Article 27 of the Basic Education Act are not functioning effectively due to the lack of lower-level legal systems. Therefore, the state and local governments must pursue systematic and efficient policies through the enactment of the Education Welfare Act, and it must become the basis for consistent delivery of education welfare services in the field.
