선거운동의 자유와 규제에 관한 소고 — 확성장치 사용 선거운동 규제 문제를 중심으로 —

「공직선거법」은 제1공화국의 암울했던 과거에 대한 반작용에 따라 ‘선거의 공정성’을 강조한 규제 중심의 법률로 제･개정되어 왔고, 특히 이 논문의 연구대상인 확성장치 사용 선거운동에 대한 규제는 변화된 사회의 가치관과 과학기술의 변화를 담지 못한 채 1963년 신설 당시의 모습을 거의 그대로 유지하고 있었다. 또한 헌법재판소는 이런 모습에 대해 소음 발생에 대한 국민의 건강권과 생업 보호, 선거에 대한 전반적인 혐오감 방지 등의 이유를 들며 이 규제가 헌법에 합치한다고 결정했다. 이런 「공직선거법」과 달리, 「소음･진동관리법」과 「집회 및 시위에 관한 법률」 등 소음을 규제하는 관련 법률은 현대 과학기술을 반영한 소음 규제기준을 규정하고, 그에 대한 측정을 실시 후 기준을 초과한 경우에 대해 중지 등 명령권을 부여했으며, 이 명령을 불이행한 경우에 한해 형사제재를 부과하는 방식으로 규제하고 있었다. 이에 이 연구는 현행 「공직선거법」에서도 표현의 자유와 선거운동의 자유가 중요하다는 점을 강조하고, 선거운동에 대한 규제, 특히 확성장치 사용 선거운동에 대한 규제를 관련 법률과 같이 완화하자는 방안을 제안했다.
Abstract
The Public Official Election Act has been enacted and amended as a regulation-oriented law that emphasized “fairness in elections” in response to the First Republic's dismal past. In particular, the regulation on the election campaign using a megaphone device, the subject of this paper, remained almost the same as it was in 1963, without containing changes in social values and science and technology. The Constitutional Court also verdicted that the regulation was consistent with the Constitution, citing the public's right to health, protection of livelihoods for noise generation, and prevention of overall disgust with elections. Unlike the Public Official Election Act, related laws that regulate noise, such as the Noise and Vibration Management Act and the Assembly and Protests Act, stipulated noise regulation standards reflecting modern science and technology, gave orders such as suspension for cases exceeding the standards after measuring them, and regulated them by imposing criminal sanctions only for failure to comply with the order. In response, the study emphasized the importance of freedom of expression and freedom of election campaigns in the current Public Official Election Act, and proposed to ease regulations on election campaigns, especially those using megaphone devices, along with related laws.
