회복적 경찰활동 법제화 방안

Restorative justice aims to restore legal peace and resolve problems through reconciliation and mediation between the offender and the victim as an informal procedure at the beginning of the criminal procedure. Previous studies have proven that the success rate of restorative justice programs decreases as time passes after the occurrence of a criminal case and as formal judicial procedures proceed. If restorative justice-related systems are introduced at the police stage, which is the starting point of the criminal procedure, the positive effects are expected to be very large, but the legal basis for realizing the restorative justice model at the police stage is still very weak. In particular, with the recent adjustment of the investigative authority of the prosecution service and police, the necessity and importance of victim protection activities at the police stage have significantly increased, and securing the legal basis to support this has emerged as a major task. In response to these demands of the times, it is necessary to establish a legal basis for carrying out restorative police activities in the process of crime prevention and criminal investigation. In addition, it is necessary to prepare such regulations so that they can be in harmony with the existing legal system without conflict, thereby establishing a legal and institutional foundation for sustainable and developable restorative police activities in the future.
