법과학 증거의 신뢰성 제고를 위한 법과학 법제 제정방향-영국 법과학규제관법 분석을 중심으로-

The study highlights the necessity of establishing a legal framework to ensure the reliability of forensic evidence, exploring the legislative direction for Korea’s forensic science laws with a focus on the UK’s Forensic Science Regulator Act. In response to forensic evidence reliability issues, the UK has enacted and implemented the Forensic Science Regulator Act, mandating standards, compliance, and accreditation. By analyzing the UK’s example, this study examines implications for Korea’s forensic science legislation. Specifically, it reviews the main provisions and implications of the UK’s Forensic Science Regulator Act, a comparative analysis of proposed forensic science laws in Korea, and an examination of the direction for Korea’s legislation in forensic science. The findings underscore the need for a comprehensive forensic science legal framework, including the establishment of a Forensic Science Committee under the Prime Minister’s Office, mandatory adherence to standards, acquisition of accreditations and qualifications, and the establishment of an evidence management system. This study can serve as foundational material for the development of forensic science legislation in Korea.
