中国城乡居民医疗电子健康档案信息隐私保护机制研究

In recent years, as the development of information resources for the medical personal electronic health records of urban and rural residents continues to increase, the problems associated with the use of medical personal electronic health records of urban and rural residents have become increasingly prominent.At present, the effective collection of urban and rural residents‘ personal electronic health record information in the community and the standardisation of urban and rural residents’ medical personal electronic health record information management in the community have become major problems that must be solved in the development of urban public health services.The privacy protection of medical personal electronic health record information of urban and rural residents is a common concern of the medical and health sector and the legal sector.The opening of medical personal electronic health records of urban and rural residents should not only safeguard the right of every urban and rural resident to make use of the records, but also protect the privacy of the collectors of medical personal electronic health records of urban and rural residents and the privacy associates.Only by reconciling the conflicting rights of users and collectors of medical electronic health records of urban and rural residents can the opening of medical electronic health records of urban and rural residents be carried out smoothly. Under the environment of intelligent medical care, new medical service modes such as telemedicine, mobile medical care, and collaborative medical care are constantly emerging, and these new medical service modes are inseparable from the extensive collection, safe transmission, and scientific utilisation of urban and rural residents' medical personal e-health record privacy information.This paper firstly outlines the definition of the right to privacy of medical personal electronic health records of urban and rural residents, and summarises the characteristics of the right to privacy of medical personal electronic health records of urban and rural residents.Then, this paper summarises the laws and regulations protecting the privacy of medical personal electronic health records of urban and rural residents, and analyses the types of infringement on the privacy of medical personal electronic health records of urban and rural residents in China at present.On this basis, it points out the deficiencies in the protection of the privacy of medical personal electronic health records of Chinese urban and rural residents, and puts forward relevant suggestions for improving the legislative protection of the privacy of medical personal electronic health records of Chinese urban and rural residents.
