IT·콘텐츠기업의 근로시간 활용에 관한 연구

As we enter the 4th Industrial Revolution, employment types and ways of working have become more diverse. However, the current Labor Standards Act regulates working hours uniformly, without considering the specific needs of different industries and occupations. This creates difficulties for employees in managing their own working hours and for employers in distinguishing between working hours and break times under the Act. Particularly, IT and content companies face limitations with the 52-hour workweek restriction, despite their need for creativity and speed. To address these issues, a reform of the Labor Standards Act for IT and content companies could be considered as follows. First, as a part of measures to respond to changes in the way one works (working), the flexibility of working hours increases and the labor and management autonomously may choose to work overtime. Second, as a way to expand the flexible working hours system, the unit period or settlement period is expanded, and the requirements are relaxed. Third, it is to expand the scope of special circumstances for approved overtime work and to expand the special sectors for special overtime work. Fourth, it is necessary to clarify the industries and duties of the comprehensive wage system such as the game industry and to take a legislative approach to this.
