제도적 상보성 개념을 통한 산재보험법상 특례제도의 변화에 관한 연구

The purpose of this study is to analyze the changes of the special cases under the Industrial Accident Compensation Insurance Act for the protection of dependent contractors. In addition, the institutional complementarity between employment insurance and industrial accident compensation insurance was focused on as the cause of this institutional change. The results of the analysis are as follows. First, the special cases concerning workers under the Industrial Accident Compensation Insurance Act abolished the exclusivity requirement and the application exclusion application clause due to the influence of the special cases concerning workers under the Employment Insurance Act. Second, the expansion of the scope of application through the enforcement decree expanded the scope of application as the special cases under the Industrial Accident Compensation Insurance Act and the special cases concerning workers under the Employment Insurance Act influenced each other. Therefore, the implications of this study are as follows. First, this study has theoretical implications in that it discussed the synergy effect between systems among institutional changes. Second, this study has theoretical implications in that it discusses rapid institutional changes due to institutional complementarity. This study has significance as an empirical case study that discusses institutional change through the theory of institutional complementarity.
