정부 및 국회 입법영향분석제도의 법제화 방안 - 중국 입법평가제도와의 비교를 중심으로 -

초록
입법과정에서 그 법에 대한 입법 전후의 평가는 꼭 필요하다. 입법 전 평가를 통해 법을 잘 제정해야 하고, 입법 후 평가를 통해 제정된 법에 대한 개선과 정비가 이루어져야 한다. 그동안 해외의 입법평가에 관한 연구가 이루어져 왔으나, 중국의 입법평가를 주제로 한 연구는 찾아보기 어려웠고, 우리나라의 입법영향분석 제도에 관한 연구 중에서도 이 논문과 같이 정부입법과 의원입법 각각의 입법영향분석 제도를 통합적으로 아우르는 연구는 드물다. 특히 이 논문은 2023년 말부터 의원발의 법률안에 대한 사전 입법영향분석 보고서가 정식으로 발간되기 시작하고, 2021년 현행 법령에 대한 정부의 사후 입법영향분석 근거가 법률로 마련되는 등 입법영향분석제도를 둘러싼 최근의 일련의 변화를 담아냈다는 점에서 의의가 크다. 이 논문에서는 먼저 한국 입법영향분석제도의 특징을 분석하고 문제점을 진단한 다음, 중국의 입법평가제도의 특징을 마저 분석하여 시사점을 도출해낼 것이다. 사전 입법영향분석 결과가 법 시행 후 사후 영향분석 및 그에 따른 궁극적인 법령 정비에까지 나아갈 수 있다면 입법영향분석이 이상적으로 완결된다고 하겠다. 다만 국회의원의 의뢰를 받아 실시할 수밖에 없는 현행 사전 입법영향분석의 성질상 입법영향분석의 객관성과 중립성을 어떻게 확보할 것인가에 대한 방안을 마련하고 이를 보장할 수 있어야 할 것이고, 입법영향분석의 대상은 규제법안뿐 아니라 비규제법안을 포함하는 방향으로 규정되어야 한다. 사후 입법영향분석과 관련해서는, 정부와 국회는 조례의 규정을 참고하여, 사후 입법영향분석의 적용 범위 등에 대한 구체적이고 명확한 가이드라인을 속히 마련해야 할 것이다.
Abstract
Pre- and post-legislative evaluations of a law are essential to the legislative process. The pre-legislative evaluation is necessary to ensure that the law is enacted well, and the post-legislative evaluation is necessary to improve and modify the enacted law. While there have been studies on legislative evaluation in other countries, it has been difficult to find a study on legislative evaluation in China, and among the studies on legislative impact analysis systems in Korea, there are few studies that integrate the legislative impact analysis systems of government legislation and parliamentary legislation, such as this paper. In particular, this paper is significant in that it captures a series of recent changes surrounding the legislative impact analysis system, such as the official publication of preliminary legislative impact analysis reports on legislative bills from the end of 2023, and the establishment of the basis for the government’s post-legislative impact analysis of current laws in 2021. This paper will first analyze the characteristics of Korea’s legislative impact analysis system and diagnose problems, and then draw implications by analyzing the characteristics of China’s legislative evaluation system. Ideally, legislative impact analysis is complete if the results of preliminary legislative impact analysis can lead to post-implementation impact analysis and eventual legislative reform. However, due to the nature of the current preliminary legislative impact analysis, which can only be conducted at the request of lawmakers, measures should be taken to ensure the objectivity and neutrality of legislative impact analysis, and the scope of legislative impact analysis should be defined to include not only regulatory bills but also non-regulatory bills. Regarding the post-legislative impact analysis, the government and the National Assembly should promptly issue specific and clear guidelines on the scope of the post-legislative impact analysis, referring to the provisions of the Ordinance.
