초록
현대 사회는 급격한 기후변화, 도시화, 초연결사회의 고도화 등 다양한 요인으로 인해 재난의 규모가 점차 대형화되고, 새로운 유형의 재난도 끊임없이 등장하고 있다. 이러한 변화는 재난안전 관리를 위한 혁신적인 접근방식과 첨단 기술의 적용에 대한 기대와 필요성을 크게 증대시키고 있다. 특히 인공지능(AI)은 방대한 데이터 분석을 통한 정확한 예측과 신속한 의사결정을 지원함으로써, 재난의 예방, 대비, 대응, 복구의 전 과정에서 중요한 역할을 수행할 잠재력을 지니고 있어 주목받고 있다. 이에 따라 재난안전 관리에 AI 기술을 효과적으로 활용하기 위한 법적 기반을 모색하고, 공법적 과제를 고찰하는 것은 필수적이다. 재난안전에 관한 법적 측면에서도 AI 활용을 위한 제도적 기반 마련의 중요성이 그 어느 때보다 강조되고 있다. 그러나 여전히 해결해야 할 입법적 과제도 많이 찾아볼 수 있다. 따라서 재난안전 분야에서 AI 기술의 효과적인 활용 방안을 모색하는 한편, 기존 법제의 한계를 분석하고 이를 개선하기 위한 체계적인 논의가 필요한 시점이다. 본 연구는 인공지능 시대의 재난관리 패러다임 변화를 중심으로 디지털트윈과 생성형 AI와 같은 첨단 기술의 적용 사례를 분석하고, 재난 회복력 관점에서 AI 활용 방안을 살펴본다. 또한, 재난관리에서 요구되는 지능정보 및 재난안전 정보를 효과적으로 활용하기 위한 법적 근거를 도출하며, 재난관리 원칙과 현행법이 자연재난과 사회재난을 구분하여 관리하는 체계가 AI 활용에 있어 가지는 한계를 논의한다. 이를 통해 재난안전 관리의 효율성과 신뢰성을 제고하고, 통합적이고 실효성 있는 관리 체계를 마련하기 위한 공법적 과제를 제시하고자 한다.
Abstract
In contemporary society, the scale of disasters is gradually increasing, and new types of disasters are constantly emerging due to various factors such as rapid climate change, urbanization, and the advancement of hyper-connected societies. These changes have significantly amplified the demand for innovative approaches and the application of advanced technologies in disaster management. In particular, artificial intelligence(AI) has garnered attention for its potential to play a crucial role throughout the entire process of disaster prevention, preparedness, response, and recovery by supporting accurate predictions and rapid decision-making through the analysis of vast amounts of data. Consequently, it is essential to explore the legal foundation for the effective use of AI technology in disaster management and address the associated public law challenges. From a legal perspective, the importance of establishing an institutional framework for AI utilization in disaster safety has never been greater. However, there are still numerous legislative tasks that need to be addressed. Therefore, it is time for a systematic discussion to explore effective ways to utilize AI technology in the field of disaster safety, while analyzing the limitations of the existing legal system and seeking improvements. This study analyzes cases of applying advanced technologies, such as digital twin and generative AI, focusing on the paradigm shift in disaster management in the age of artificial intelligence, and examines ways to utilize AI from the perspective of disaster resilience. Additionally, it derives the legal grounds for effectively utilizing intelligent information and disaster safety data required for disaster management and discusses the limitations of the current legal framework, which distinguishes between natural and social disasters in terms of disaster management principles and existing laws. Through this, the study aims to present public law challenges that will enhance the efficiency and reliability of disaster management and contribute to the establishment of a comprehensive and effective management system.
