대한민국 포괄적 과거사청산 법제에서 국가불법 구성요건검토

초록
헌대한민국의 현대사는 수많은 국가불법이라는 질곡의 연속이었다. 이러한 국가불법은 1987년 민주화운동을 기점으로 개별적 과거서청산입법으로 청산되기 시작했으나 청산대상과 범위, 인정기준과 청산방식에 있어서 형평성과 실효성 논란을 야기했고, 이러한 한계를 극복하기 위해서 「과거사정리법」등 포괄적 과거사청산입법이 도입되었다. 하지만 포괄적 과거사청산입법도 국가불법에 대한 명확한 정의규정이 없어 무엇이 청산해야 할 국가불법인지 제대로 제시해 주지 못하고 있고, 이는 과거사청산의 본질을 흐리는 부작용을 낳고 있다. 본 논문은 국가불법의 개념을 국제법적, 국내법적 논의를 개관하면서 수립하고, 우리나라의 포괄적 과거사청산법제의 국가 불법구성요건과 관련된 문제점을 검토한 뒤, 국가불법의 일반적 구성요건을 도출하는 것이 주요 목적이다. 그리하여 “국가 또는 국가의 지시ㆍ감독을 받은 자가 불법적으로 국민이나 그 국민의 유족 또는 친족관계를 가지고 있는 자에 대하여 기본적 인권 등 헌법이 수호하는 자유민주적 기본질서를 전면적 부정하거나 중대하게 침해한 경우이거나 국가에 의한 국민에 대한 집단살해죄, 반인도적 범죄, 전쟁범죄, 침략범죄 등 국제법상의 중대한 범죄행위 저지른 경우 또는 그러한 행위로 중한 결과에 이르게 되었다고 의심할 만한 상당한 사유가 있었을 경우”로 국가불법의 일반적 구성요건을 제시하고 있다.
Abstract
The modern history of South Korea has been characterized by a series of state illegalities. Starting with the democratization movement in 1987, these state illegalities began to be liquidated through individual past liquidation legislation. However, there have been controversies over the equity and effectiveness of the liquidation targets, scope, recognition criteria, and liquidation methods. In order to overcome these limitations, comprehensive past liquidation legislation such as the Past Business Organization Act was enacted. However, the comprehensive past liquidation legislation does not provide a clear definition of state illegality. Therefore, it does not provide a clear definition of what constitutes a national illegality. This clouds the essence of the law. This paper defines the concept of state illegality, examines the problems related to the state illegality component of the comprehensive past liquidation legislation, and derives the general components of state illegality.
