이 글에서는 1950년대 후반 냉전의 균열 인식을 기반으로 국제사회의 ‘권력정치’를 비판하고 나섰던 지식인 중에서 국제법학자들의 논의를 ‘국제법을 통한 국제평화’ 모색을 중심으로 다룬다. 한국전쟁 이후 이승만 정권의 반공주의는 제3세계 민족주의의 약진과 국제정세의 흐름을 반영하지 못했고, 지식인들은 변동하는 세계를 해석하고자 현실주의 국제정치이론에 주목하여 ‘국가이익’을 중심으로 한 강대국의 ‘권력정치’가 국제사회에 투영되고 있음을 인식했다. 이 글에서 검토한 박관숙, 박재섭과 같은 국제법학자들은 1950년 한국전쟁에서 재현된 국제사회의 규범을 국제법으로서 체계화하고 있었고, 이를 통한 ‘국제평화’를 구상했다. 그러나 1950년대 후반 헝가리 사건에 대한 국제사회의 제재가 실패하자, 국제법학자들 사이에서도 국제법 작동의 유효성에 회의적 평가가 확대되고있었다. 1950년대 후반 국제사회론에 대한 문제의식은 강대국의 ‘권력정치’가 국제사회에 재현되고 있음을 비판하면서, ‘권력정치’의 해소를 주장하는 것으로 변화했다. 이는 국가 간 협력을 통해 ‘국제평화’ 달성을 주장한 것이었고, 당대 ‘평화관념’과 결부되어 있었다.
Abstract
This paper examines the discussions among international law scholars in the late 1950s who critiqued the ‘power politics’ of the international community, focusing on the pursuit of “International Peace through International Law” based on an awareness of Cold War divisions. Following the Korean War, the anti-communism stance advocated by Syngman Rhee’s regime failed to reflect the rise of Third World nationalism and the shifting dynamics of international relations. Intellectuals, seeking to interpret the changing world, turned their attention to realist international political theory, recognizing that the ‘power politics’ of great powers were being projected onto the international stage, centering on their ‘national interests’. International law scholars such as Kwan-Sook Park and Zai-sup Pak, reviewed in this paper, codified collective security and international norms that were demonstrated during the 1950 Korean War into a framework of international law, envisioning ‘international peace’. However, the failure of international sanctions in response to the Hungarian Revolution in the late 1950s led to increasing skepticism about the effectiveness of international law even among legal scholars. The critical awareness of the international society highlighted the ‘power politics’ within the global arena and argued the resolution of ‘power politics’. This ultimately advocated for the achievement of ‘international peace’ through cooperation and was tied to ideas of ‘peace’.
