국제형사재판소의 피해자배상명령의 집행실태 분석

본 연구는 국제형사재판소가 피해자배상명령을 내린 루방가 사건, 카탕가 사건 및 알 마흐디 사건에서의 피해자배상명령의 집행실태를 구체적으로 분석하여 향후 피해자배상제도의 효과적인 운영과 개선을 위한 방안을 제시하는 것을 목적으로 한다. 먼저 본 연구에서는 각 사건의 배상명령과 집행계획의 내용을 파악한 후, 배상명령의 집행실태를 구체적으로 분석하기 위해서 i) 배상명령이 실제로 어떤 집행방식(신탁기금 직접 시행방식, 중개기관 사용 방식)에 의해서 집행되었는지 그리고 그 이유는 무엇인지, ii) 중개기관을 선정하는 절차는 무엇이었는지, iii) 재판소는 배상명령의 집행시에 신탁기금을 어떻게 감독을 하였는지, vi) 피해자 인정을 누가 최종적으로 결정하는지, v) 신탁기금이 배상수혜자의 적격과 피해자의 피해를 어떻게 검증하였는지, vi) 배상명령, 벌금 및 몰수에 의해서 수집된 자산이 배상명령을 집행하기에 충분하지 않은 경우에 신탁기금이 보유하고 있는 기타 자산에 의해서 배상금을 얼마나 그리고 어떻게 보완하였는지 등에 대해서 분석할 계획이다.
Abstract
This study aims to analyze the implementation of reparations orders in the Lubanga, Katanga, and Al Mahdi cases, in which the ICC issued reparations orders, in order to provide recommendations for the effective operation and improvement of the reparations system in the future. In order to specifically analyze the implementation of the reparations orders, after first identifying the content of the reparations order and the implementation plan in each case, This study will examine: i) how the reparations orders were actually implemented (directly by the Trust Fund or through the use of intermediaries) and why; ii) what were the procedures for selecting intermediaries; iii) how the Trial Chamber supervised the Trust Fund in the implementation of the reparations orders; iv) who makes the final determination of victim recognition; v) how the Trust Fund verified the eligibility of reparations recipients and the victims' damages; and vi) how much reparations were supplemented by other assets held by the Trust Fund in cases where the assets collected by reparations orders, fines, and confiscations were insufficient to enforce the reparations orders.
