초록
오늘날 경제안보가 중요한 이슈로 부상하면서 그동안 국제통상체제를 중심으로 논의되어 오던 데이터 관련 이슈도 국가안보의 맥락으로 논의의 초점이 이동하고 있다. 이러한 변화는 데이터의 경제적 중요성 뿐 아니라 국가안보상의 중요성에 대한 인식이 심화되기 시작한 현상과 맞물려 있다. 특히 기술의 발전과 함께 데이터의 군사적 활용 가능성이 증가하고 데이터의 악의적 사용에 따른 일련의 사례들이 등장하면서 데이터 통제의 필요성이 심화되는 상황이다. 이러한 상황에서 본고는 데이터 및 데이터의 국경 간 이전에 대한 국제사회의 시각이 시기적으로 변화되어 왔음을 살펴보고, 향후 국제통상체제에서 예상되는 제도적 영향 및 변화를 전망하고자 한다. 이에 데이터에 대한 국제사회의 인식이 디지털 경제의 활성화 수단에서 국가안보의 핵심 쟁점으로 변화한 배경 및 과정을 시기별로 구분하여 분석하고, 특히 데이터 안보와 관련된 주요 쟁점 및 현행 국제사회의 조치 현황을 탐구한다. 또한 다자수출통제 체제의 변화 가능성, 공급망에 미치는 영향, 그다리고 데이터에 대한 관세 부과 가능성을 중심으로 국제사회의 제도적 변화와 그 시사점을 논의한다.
Abstract
As economic security rises to the forefront of global priorities, discussions surrounding data—historically anchored in international trade frameworks—are increasingly reframed through the lens of national security. This shift reflects a growing recognition of data’s significance not only in economic terms but also in terms of security imperatives. The evolving technological landscape, which amplifies the potential for military and malicious uses of data, has heightened calls for data control measures. This paper traces the international community’s shifting view of cross-border data transfers, analyzing this transition across distinct phases and examining the current landscape of data security challenges and regulatory responses. Furthermore, it explores the anticipated institutional impacts within the global trade system, including potential adjustments to multilateral export control regimes, supply chain vulnerabilities, and the prospect of data-related tariffs. This study aims to offer insights into the broader implications of data securitization for international trade frameworks.
