EU단일특허제도와 유럽통합특허법원 도입과 시사점 고찰: 우리나라에 미칠 영향과 그 대응전략을 중심으로

UPS와 UPC는 기존 유럽 특허제도의 문제점으로 지적되어 왔던 비용, 효율성, 법적 안정성을 보완하고자 출범했다. 이로 인해 유럽 특허 업계가 큰 전환점을 맞이했고, 우리나라도 그 변화로부터 자유로울수 없다. 이 제도는 기존 제도의 단점을 보완하는 긍정적인 효과를 가져오지만 동시에 단점도 여전히존재한다. 또한 특허보호의 분열, 재판권 분열, 법정지 선택의 문제, 중소기업에 대한 효과 문제 등의쟁점이 존재한다. 본 연구에서는 우리나라의 특허 산업 보호와 기업들의 경쟁력 제고를 위해 이러한요소들을 고려하여 종합적인 대응 방안을 제시해보고자 한다. 지금까지 서울반도체, 서울 바이오시스등의 우리나라 기업들이 통합특허소송을 진행한 바 있다. 아직은 연구를 위한 사례가 부족한 편이지만앞으로 우리나라 기업들의 UPS 제도 활용은 점차 늘어날 것이고 이를 보다 효과적으로 활용하기 위해서는 적절한 대응 마련이 필요하다. 이에 기업적 차원에서 출원 전략으로 핵심 특허 분산관리를 제시하였고, 전담인력의 강화와 옵트아웃 활용 전략, 소송펀딩, 상호합의 등을 제시하였다. 또한 바이오제품 산업에서 보다 적극적으로 대응해야 할 것을 주장했다. 국가적인 차원에서는 중소기업의 전담인력강화 지원 제도 마련과 IP 자격 인증제도 활성화를 통한 유럽 특허제도 전문가 양성, 소송펀딩 제도 활성화를 전략으로 제안하였다. 본 연구에서는 그 대응전략의 개략적인 방향만을 제시하였는데, 후속 연구를 통해 보다 구체적이고 실질적인 대응전략을 마련해야 할 것이다.
Abstract
The European patent industry has reached a major turning point because of the launch of its Unitary Patent System (UPS) and Unified Patent Court (UPC). South Korea is also affected by these changes and issues such as fragmentation of patent protection and jurisdiction, problems of choice of forum, and negative effects on small businesses. This study proposes a comprehensive strategy that considers these factors to protect Korea's patent industry and improve the competitiveness of Korean companies. Korean companies will increasingly use the UPS; therefore, appropriate responses are needed to employ it more effectively. Accordingly, measures such as strengthening dedicated personnel, appropriately using agreements, and responding to patent litigation using opt-outs were proposed at the corporate level. At the national level, it is recommended to establish a support system to strengthen the dedicated workforce of small enterprises and train European patent experts. More specific and practical actions should be developed in future studies.
